Criteria for DCF

Hi, Jay and I are new to this, but what a lucky find it's been. You don't realise just how many people are going through the same thing. It's nice to know we are not alone.

Okay now to the question. What are the criteria for deciding if you are eligible for DCF? I know it says you both have to be living abroad- but for how long?

Like everyone on here, we want to be together as soon as we can. I was wondering if it is possible for me on a visit to the UK to attempt to process the I-130 through the embassy in London. (We have not yet got married - though obviously we would be before filing).

Any information about this would be appreciated, and if anyone from the UK has succesfully used DCF too.

The BEST thing you can do is read EVERYTHING you can on this site about DCF - there are guides, and then country specific outlines.

There are only a few countries where you can file DCF if you don't live there...I don't think the UK is one of them but I could be wrong. You have to e-mail or call your embassy and ask them if you can - really. read the guides first...

Finally finished with immigration in 2012!

Hi and welcome to the board.

Lots of great information here for you to research and read and people who will help you too.

From what I've read, I'm pretty sure you would have to be a resident of the UK in order to do DCF there so just going to visit on the VWP(Visa Waiver Program) wouldn't help you. There are a lot of USC's(U.S.Citizens) on this board who have been resident in the UK and utilized DCF also many who have used K-1 for finances and K-3 for spouses.

Best thing to do to start with is start searching this site and read read read. Exciting isn't it?!!

Two folks who pretty much know all the Ins & Outs of Emigration are Meauxna & Aussiewench and I'm sure they'll be along to give you some good advice.

8-12-2004 I moved to New Zealand(married my Kiwi in US 5/04)

1-12-2006 Received initial packet - It has I-130, I-864 & DS-230 Part 1, DS-2001 & tons of instructions.

Gathering paperwork that we don't have:

5-30-2006 - I-130 FILED AND ACCEPTED BY AUCKLAND CONSULATE!- INTERVIEW: 6/13/2006

Thanks for all the information. It's pretty much as I thought it would be. So it looks like we'll be going for the K1 then. Can't file until around the second week of March, but after then all our focus is on getting Jay stateside as soon as possible.

In order to do a DCF through London you must have an Indefinite Leave to Remain stamp in your passport. This would require you to be la resident of the UK for at least 2 years. SOrry, but you cannot file an I-130 through London on just a visit.

This is not necessary the case... We applied and I only have a limited leave to remain and we were approved!

I had been living here for 2 and 1/2 years when we applied and had only been married for 6 months when we started. So I reckon that they make certain exceptions.

Ana, I agree with you. The fact that you had been living in the UK for that length of time likely had more to do with your case getting accepted than which particular visa stamp you had.

so how is the filing done for say Lebanon? where is all of the paperwork processed?? i am so confused at the moment....dh and i have been married since June, we got married in the us, we are going to file the I130 with the Beirut Embassy the 22nd is our appointment to do that....where will it be sent?? how are things processed like that??? and what about filing the waivers when we have to? will the embassy here be the ones telling us what to do next? do we file all the papers we have t with them?? we just moved here Jan 17th. i have a mult entry visa and can renew it, and in the meantime we are getting my residency.. but that wont be for sometime...im just so confused.

June 11 05-Married George, civil ceremony in New York

May 30 08-Baby Joshua was born

Jan 15-Back to NY we go...

May 10-made decision not to go back overseas.

July 10-filed for divorce

Jan 11-Divorce final

July 11-1st trip to take Josh to see George

Mar 12-2nd trip to take Josh to see George

jess, I suggest that you start your own thread. You are the first to post about DCF from Lebanon, so your experiences will be a very valuable resource!
