Hello,

I have a big huge question.

My husband is in the military, we are on Overseas assignment in Germany. My Green Card should expire this June and I filed for N-400 under 319(b ).

I know I should file for I-751 three months prior my Temporary card expires but I cannot do so because my husband is deployed and though he is trying to send me the signed form for already like three months, nothing is coming.

Is there a way to extend my Temporary status since I have N-400 pending and due to the problem with my husband being deployed? What can I do and what should I show the Embassy to prove them that I'm eligible to receive an extension.

I've already been in Frankfurt Embassy here in Germany twice and they are extremely unhelpful, they don't want to do anything at all and because I don't know proper USCIS memo for this or regulation, they just send me home.

What I should add is, that I'm having in my passport the whole time just stamped CR-1 visa, serving as I-551 and I never received the actual Green card, I was questioning USCIS every single month and right when that stamp in the passport for entering States expired, they've sent me letter that they LOST my visa packet and that's why I never received my card and what I was supposed to do was to go to any "local" office and present "documents" and on my question what local office and what documents to present, nobody answered and when I tried the same in Frankfurt Embassy, they kicked me out with answer they are not responsible and they cannot help or give me even simple answer what to do.

I'm just happy, that Nebraska Service center told me that I'm not out of status because of my husband's Overseas orders and because I'm his dependent here the whole time... and that I can avoid part of the troubles by filing for my Naturalization.

I know this is a big question and I don't know if anyone ever dealt with thing like this.. I would be very thankful for any hint anyone could give me, since it looks like I don't get any help from the Embassy.. and JAG lawyers over here don't know what to do either.

JAG use to be my favorite TV show, know it's a make believe world, but was nice watching competent people at work, you can tell I was in the military. Mail also gets lost, and if you have a computer, try printing out another I-751 and sending it again. What branch is he in? Any contact with your husband at all?

When I needed help, had to go up the ladder, sure don't want to go down, both your congressman and senator have a competent immigration person on staff, least mine does. I am having problems reading your post, can tell you are alone and emotional, but try and be specific as to precisely where you stand and what you are trying to accomplish.

You can contact your senator at your husbands own state via e-mail by finding him/her at:

Or your husband's congressman at:

https://forms.house.gov/wyr/welcome.shtml

On either site after you find out who it is, look for contact information, should find a form to e-mail them directly from the site, can copy and paste your letter, print it out, and save it for your files.

See the other respondant suggested you try JAG when you already stated they can't help you, that isn't much help. Also have members of the armed services here that hopefully will reply, military people have to stick together, I have been out for awhile.

Sorry I missed the part about JAG not being helpful (it was at the end... it was late when I responded & I was tired from a trip). When you go see JAG the lawyer you talked with might not know the answer but if he actually wants to help they basically have a network of other JAGs that they can tap into, some of whom are very versed on immigration matters. Like Nick said you can try your congressman, they might help (I contacted one in my case & his staff was pretty responsive... I am also military & many politicians are pro-military).

LOL, nowhereman, yes, we all get tired, peace!

But you do bring a good point, and that is developing an unwillingness to accept, "no" for an answer, something very difficult for a newcomer to do in this country. But at times necessary, it's your life and future at stake.

You should not ignore the petition to remove condition even you filed the N400 application.. Service centers has different processing date, so there is no assurance that because like me was processed in a very short period of time will be the same thing to others.. And there is no assurance as well that the application for N400 319b will be approved, so you have to file the removal if you did not receive any interview letter from USCIS pertaining to your N400 application.

The CR1 stamp in the passport is just temporary and once they issued the greencard they will revoke the stamp. From what I notice that stamp has 1 year validity, check it and see if there is an exxpiration date inidicated there..

I dont know what else to say.. i think this is terrible case.. Goodluck
