I went to the US Embassy here in Australia to get my son his passport and a SS #. They told me that I need to show proof that I have lived in the states for at least a total of 5 yrs. All my important papers are in a storage unit in Florida, and I dont have anyone that can access it. Does anyone know how I can proove my residency from overseas. I dont have much time as I have already overstayed my visa, and need to get back stateside ASAP without leaving my son.

What Part of Florida? How long have you lived in the US.

Copies of tax transcripts can be ordered over the internet but if you call the 800 number and offer to pay postage you can probably have the records mailed or faxed to you. If not contact a reputable accounting office that handles corporate taxes. ( There should be a local one in the area of Florida.) Most corporate tax accounting offices also handle some personal records. You will probably have to pay for the service but accountants are much cheaper than attorneys and they are used to providing proof to the US government. The cheapest way to go would probably be to contact a few past utility companies and have them email you or fax you copies of past bills. Plus you can get affidavits from employers and friends etc. If you do not have a place of residence in the US in your name then you might be able to use a certified statement from a friend or parent proclaiming that you have and will live with them upon retun to the US.

When I went to the US embassy they said I couldnt use a signed affidavid even if my father had a notory stamp and sign his statement. I will see if calling the 1-800 IRS number that they can fax the info to the US embassy, but I would hate for the IRS and the embassy to get info crossed and my fax get lost as its like 36 USD per yr. Hopefully I can figure this out soon because I need to get this fixed asap and I WILL NOT leave my son here without me being with him.

You should be able to go to www.accuverify.com where you can pay a smaller charge and they can email your transcripts to you!

I'm not sure where the $36 a year comes in to it, is this what they charge for having the transcripts faxed to Australia? They faxed mine to me for free, granted I am in Canada.

They want you to prove residency, have you thought about school or University attendance records (could perhaps call them and ask for a copy)? Work pay stubs or letters of employment that a previous employer might fax you, bank account statements etc etc.?

He. once he has a US Passport will be free to enter the US, what about your wife?

Can you not legalise your position in Australia.
