Sorry anaother question ,,

Hi all the members ,,

is there a defferent bettwen the K3 and the IR1/CR1 visa ??? and if it , what the defferent ??

and do we need to fill both of thos petitions ? how much dos thats cost us ?

good morning

i agree with pushbrk start to read the guides first

and for sure there are some differences between k3 and CR1 visa and you can just file for one visa k3 visa or CR! visa you can not file for two visas at the same time

but i don't know if you will find the fee there or not

its about 355 USD for the k3 plus almost 100 USD for the medical exam plus 131 for the visa fee plus some money for other stuff ( like travel to USA embassy in Cairo for the interview , translate some papers , print some pictures , DHL fee to send your paper to the embassy and to send the visa from the embassy to your home......)

and about how long it will take it up to your luck maybe 6 months maybe 7 , 8 .....

As far as I know, you have to file for the I-130 and K3 together (or if you want, just the I-130 separately). But if you want K3 you have to file I-130 first and wait for receipt notice from Service Center, before you can file for the K3. The K3 was actually created to help by-pass the supposedly longer wait times for I-130 (although in our case it turned out the I-130/CR-1 was faster to be approved and for my husband to get an interview at the consulate). Read the guides - they probably explain it better than I can.

K3 and CR1 are visas. I-130 and I-129F are forms

CR1 = I-130

K1 = I-129F

K3 = I-130 + I-129F

If you just send the I-130, it's a CR1 petition. If after receiving the NOA1 for that, you send the I-129F, it turns into a K3 petition.

We are not sure if the K3 is still active. Officially, it is, as there is no official statement. but we have been seing a lot of I-129Fs being administratively closed once the I-130 is approved.

You should opt for K3 if you priority is to get things done fast, the time difference between K3 and CR1 varies, but it can add up to several months. That's the only advantage with the K3.

The K3 visa requires two petitions. The I-130 alone would result in a CR1 or IR1 visa. The second petition, I-129F is designed to result in the K3 visa, so yes you do petition for two visas and it used to be possible to obtain the K3, then go interview for the CR1 later instead of adjusting status. The whole K3 issue is up in the air now and looks dead on arrival.

K3 = I-130 + I-129F

The problem is that in the present tense, filing the I-129F is not resulting in a K3 visa. Instead it simply slows the CR1 process. I do not advise filing an I-129F at this time. Things may change again later. I think they should and hope they do but not now.

Because the two cases are put together and move forward according to the I-129F priority date instead of the earlier I-130 date. All the time between I-130 and I-129F filing dates is lost.

In some recent cases that's been more than four months down the drain.

I am embarrassed to ask, but I really don't understand this. If indeed it is true that

the I-129F, the route to K-3 is closed, does that mean that all K-3 applications are

automatically converted into CR1/IR1 applications? Then switching now and going

for a CR1/IR1 is not really necessary? Would slow things down even more?

I think your confusion comes from mixing terms. It's a common error. I-130 and I-129F are not "applications for visas". They are petitions filed by USCs, which when approved will authorize the eventual beneficiary (in this case the foreign spouse) to apply (at a Consulate abroad) for a visa. An approved I-130 authorizes appication for a CR1 or IR1 visa. I-129F for spouse authorizes application for a K3 visa.

If USCIS forwards the I-130 to NVC and onward and by whatever means "keeps" the I-129F, the the CR1/IRi (immigrant visa) process is the one that continues.

No, you don't need to do anything for your immigrant visa process to continue after the I-130 is approved.
