Timeline

Hi,

We're coming up on 2 years anniversary in June and I will have to put in Lifting of Conditions form.

My wife already got a Permanent Resident Card that is valid until April of 2009.

She wants to travel to her home country in June for 2 month.

Is her CG enough for her to come back or should she wait until Conditions have been lifted?

Yes all she needs is her Greencard and a valid passport.....

About the lifting of conditions.... you file 90 days before the expiry date on the Greencard not your 2nd aniversary.... so if her greencard expires in april 2009 you can file to lift the conditions sometime in January 2009.... not June 2008..

Read the I-751 guide compleatly:

You will receive a notice of receipt for the form stating that "Your alien card is extended one year - employment and travel authorized". Keep the receipt with your green card. If by some chance you are not approved within a year you will want to make an InfoPass appointment to go to your Local Office to request an I-551 stamp in your passport.

I-751 NOA1 letter extends the green-card for a year. Use the letter and expired card to re-enter the country from a trip abroad.

Yep, i should have caught that 2nd wedding anniversary quote. Yes look closely at the green-card, you needs to file the I-751 within 90 days before it expires, 2nd wedding anniversary has nothing to do with lifting of conditions.

People get 2nd wedding anniversary confused in this process. If adjustment of status (I-485) or an immigrant visa (IR-1) is approved after the 2nd wedding anniversary then an un-conditional card will result.

So in other words she will be ok to travel this summer if her GC expires a year from now.

Would CG and her unexpired foreign passport be sufficient to reenter US?

If her passport is in her maiden name and her GC is in her married name, then she should take a copy of your marriage certificate just in case they ask for it too.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

01/17/09: Applied for US Passport and passport card

01/28/09: Received US Passport

01/29/09: Received US passport card
