hello all,

my fiance just received his packet 3 and we are working on getting it sent back in. my fiance and i met back in 2005 and had a long distance relationship for about 1 year. then he came to the united states on a vistor's visa. while he was out here we decided that we wanted to continue our relationship but were not ready to get married, so he applied for school and was accepted. when he went back to the uk for his student visa interview he was declined because he was not able to apply to show significant ties to the uk and the embassy officer said that he was applying for the wrong visa.

i am wondering if anyone has gone through this situation. i dont want this to hurt our approval of our fiance visa.

I can't offer direct experience, merely an opinion. Your fiance IS filing the right visa now and no longer has to show ties back home.

Make sure he declares the denial on the previous visa though. Maybe the CO at the time suspected he might have reason to remain after the student visa expired i.e. you! and hence the denial. I really think you'll be fine this time around. Good luck!
