I called USCIS today , I was told that all K3 are not cancelled ...they are still taking applications ...but don't know the processing times for K3....yet to be announced.We will keep ours EARS open .....

I think we all just pray to god ...for speedy process.. :dance::dance::innocent::wacko::help:

No one is talking about flooding the forum, don't be so dramatic.

It's not the same question being asked by the same person. It's a new person trying to get information when there is an overwhelming amount of it. Do you not remember being new or did you come here already an expert? Sometimes you don't understand and phrase it differently so that you do understand.

But please, by all means, use this forum to tell people what they're doing wrong instead of trying to help.

Of course they are still accepting the petitions (not applications). The issue is what they do with them when they come out the other end.

What question did you specifically ask and what was the specific answer?

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

I think everyone should send one email to CIS Ombudsman. According to them, USCIS was questioned over a month ago and has still not replied. Maybe we can put some light pressure on it.

I already sent mine! Good idea, I think this teleconfrence was initally sparked by the emails sent to the ombudsman.

I'm relatively new as well and I have the same question. The information is almost overwhelming about this K-3/I-130 situation. It's really interesting to see that no matter where you go on the internet you see the same arguments. :lol::ranting:

Hi, I’ll post the timeline of our case - maybe it could help someone out.

The timeline form on VJ didn’t seem to make sense for our case, since both our I-130 and I-129 got approved and sent to the consulate. The one below is in mostly chronological order (CR-1 stuff in bold):

June 8, 07 - I-130 sent

June 18, 07 - I-130 receipt notice (I-129F sent shortly after)

July 3, 07 - I-129F receipt notice

July 24, 07 - I-129F sent to Vermont Service Center

July 13, 07 - I-130 approved & sent to NVC (I had to tell my lawyer at that point that I wished to pursue this visa – my husband and I just wanted whatever was quickest. She was more set on going for the K3 since it’s supposedly faster, but I asked her if I could do both, and so we proceeded)

Gathered all documents and forms required by NVC for I-130, including our AOS – don’t remember exact dates as lawyer was helping us and getting most of the mail from NVC during this time -- we finished sending everything that the NVC required by the first week of December 07.

Jan. 10, 08 - NVC sent letter saying we had all required paperwork, and would forward our case to Riyadh consulate (got visa interview date for Feb. 12)

Jan. 29, 08 –I-129F was approved & sent to NVC (our lawyer told us at this point that it didn’t matter, since we were already scheduled for interview for the CR-1, which is a better option – no mention of the K3 being “cancelled” though or anything like that)

Feb. 4, 08 - letter from NVC that they would forward I-129 to Riyadh consulate

Feb. 12, 08 - CR-1 visa interview at Riyadh consulate (seemed to go well, although no definite answer – they took my husband’s passport and fingerprints; he paid Fedex fee for passport to eventually be sent back)

-After a week went by, we tried to call consulate – no answer. Then we emailed them a few times, and they replied on Feb. 27 saying our case was under administrative review, to wait 2-3 additional weeks and email them again – still waiting… Emailed lawyer this week to ask if we should try to continue with the K3 process since maybe it would be faster due to the administrative review of the CR-1. She replied that the administrative review would apply no matter which visa we went for, so we think we should stick with the CR-1.

They said they weren't giving K3's before and then I got an RFE on my K3 a month ago and I just got my Evidence accepted yesterday and Today they touched my papers a 2nd time. I don't know but I believe I'm getting k3

Your case doesn't fall into the scenario we're discussing but it also didn't follow the USCIS stated procedures at the time you filed. What should have happened is that your K3/I-129F was forwarded to NVC and onward while your I-130 was held for use in your adjustment of status. There were a number of those errors reported from November through July but most of them had stopped by May.

The current issue is with I-129F petitions filed after the late July fee increase that removed the I-129F filing fee when filed for a spouse.

I'm actually kind of glad the error happened for us, since it seems like the CR-1 is a better way to go. We didn't expect it would happen so quickly, although the AR process right now could make up for that and take who knows how long.

After reading about all these K3 issues, I'm kind of wondering if our K3 case is still open. My husband never did receieve any further information about that, after the NVC said they were going to send the file to the consulate (and eventually they were supposed to send him some instruction package, which he never got). Perhaps it just takes time or perhaps they did "cancel" it due to us already being in the process of getting the CR-1 visa.
