AS we were checking some of the forums we noticed that some vj menbers who were filling for k3 visa has moved to cr1 saying that there is some strong rumers that k3 visa will be cancelled soon!!!!!!!!!!!! we r getting married by allah help in april and we r planning to fill for a k3visa but with these strange news it is getting us really confused so plz if any one has any further informations about it plz contact us ??????????????????

Our immigration lawyer initially told us that the K3 is usually faster than filing for the I-130 (marriage based petition). First you have to file the I-130, and then the K3 forms, which is done since it supposedly takes so much longer to process the I-130. But for my husband and I (he is Saudi), our I-130 was approved almost immediately, and we chose to go through that process (while still waiting on K3 approval). Our immigrant visa application was already sent to the consulate and our final visa appt. scheduled, when we finally heard that our K3 was approved. Needless to say, we are sticking with the CR (I-130), so that he will come here with conditional residence and not have to adjust status.

Long story short - we were able to file for both at the same time. If I were you, I would do the same thing, and whichever is approved first go for it. And if the K3 is cancelled, you will still have the I-130 filed either way. Maybe you can also consult with a lawyer, since it helped us a lot during our process. Good luck!

I didn't file a K3, but from reading others' post it seems as though when you file for a K3 you are sort of filing for 2 different visas simultaneously: (1) K3 and (2) CR-1. Then there comes a point in the processing where you are given the option chose one option to pursue. It appears as though people most often select the visa option depending on which one is expected to be processed faster at their consulate.

VJ members are being told from USCIS that there I129f's petitions for the K3 visa are administratevily closed, because their I130 petition was approved already. No one can get this in writing or find any infomraiton so far regarding this process. The USCIS is saying that they are still accepting I129f petitions.

THe uscis has cut the processing time for the I130 this is a good thing. The cr1 is a better visa for people with accomadaing embassies.

If you have an embassy that takes more time for a CR1 interview then a I129f, this is not such a good thing.

For example my embassy take 1-2 months for a K3 interview and 7-8 months for a CR1 interview, which usually goes into AP for another 4-6 months. I have an approved I130, but need to get an approved I129f/K3. My goal is to figure out if the USCIS can really do this legally.

Is your wedding plans more important then being reunited with your love one? I would recommend filling for a K1 fiance visa then get married when she arrives.

K-1 sounds a lot safer at the moment... nobody knows what's going on with K3 and CR1!

If you have that option, I think you should do that

I see you are getting some answers. I don't understand why you need your own thread on this, instead of reading the several ongoing discussions on the matter.

We have "strong numbers" of people who report (in the present tense, not "soon") that their I-129F petitions have been cancelled when their I-130 petitions are approved. This effectively nullifies the K3 visa option the I-129F was filed for.

What's more, the option of filing both petitions together that was viable for a few months has gone away and there has been a delay in receipting I-130 petitions. People filing both petitions must wait to receive receipt for the I-130 to file the I-129F. Then when they file the I-129F, their I-130 petition loses its place in line only to be processed much later than it would have been. The result is a much later I-130 approval caused by the filing of an I-129F that is eventually useless anyway.

For the time being, it appears to me there's a strong case for married people to file only the I-130 for the CR1 or IR1 visa and forget all about the K3. You file the I-130 anyway, so there's time to let this sort out a bit before making a final decision on the I-129F but it doesn't look good at the moment.

You would be wise to read the other threads on the matter. No need to ask others to reinvent the wheel just for you.

Sorry about that - I meant that I filed them about a month apart, as it did not take long to receive my receipt for the I-130. Only after that did I file the K3. I will have to work on my timeline, as I just joined today at 3am.

Also I just want to say that as a new person, I think it is hard to navigate through the hundreds of topics and find what you are looking for right away. It can be easier to start a new thread and get a quick answer to guide you, and I don't see what the problem is with that? But it is also really valuable advice to go through the existing threads and read the wealth of information that people have written over time (that is how I'm learning what is really going on with our case).

There is no reason you can't start a specific thread. There are people who rather than help, like to tell you what you should or should not do per their own perceptions, which they believe are the only ones that are correct.

Not everyone is like that, so please continue to post any questions you may have.

The K-3 situation will resolve itself I'm sure. Only time will tell if USCIS is going to continue processing them or not.

No one is talking about flooding the forum, don't be so dramatic.

It's not the same question being asked by the same person. It's a new person trying to get information when there is an overwhelming amount of it. Do you not remember being new or did you come here already an expert? Sometimes you don't understand and phrase it differently so that you do understand.

But please, by all means, use this forum to tell people what they're doing wrong instead of trying to help.

OMG! :help: yes, it seems that the board is ok if there are duplicate answers to the questions being asked.. that is why we are helping others and getting help when we needed it.. Also, it is much easier to search for the answer that you want later on.. some of the topics get "taken back" really fast, and maybe the person didn't know how to search yet (or what to search for)... :lol: don't worry, there's plenty of people that are still willing to help and not make fun of you.. :no:... we were all "new" at one point and was anxious in finding answers immediately.. this has been (still is) a frustrating process, even for me.. I still don't know what they had approved on my case.. but it is good to see people are asking the same questions.. maybe we can have a Questions FAQ or something like that.. since so many people come to this board everyday, they can update the answers as needed when they find out new stuff..

I have asked questions lately with no answers too.. mainly because my situation is different (had local office interview and PASSED).. so not many people went through what I did... so I am one of the people in a "new" territory now.. and still nervous and anxious about what to do.....
