As far as I know once your lease is up in Ontario you can stay in that apartment and rent month-to-month without signing a new lease. Doesn't really matter if they have new tenants lined up or not, I'm pretty sure you can just stay.

September 9, 2005 - NOA's for AOS, AP, (dated Sept. 1)

November 28, 2005 - AOS biometrics - refused EAD biometrics at the same time

December 5, 2005 - AP approved

December 7, 2005 - Infopass appointment for interim EAD

December 12, 2005 - Received EAD card

December 13, 2005 - Received AP

June 14, 2005 - Case Status Inquiry/Tracer

June 19, 2005 - Letter sent to congressman

AOS INTERVIEW SCHEDULED FOR AUGUST 8, 2006

AOS approved - August 8th, 2006 - hooray - done with USCIS for now!

GREENCARD RECEIVED - August 18, 2006

As far as I know once your lease is up in Ontario you can stay in that apartment and rent month-to-month without signing a new lease. Doesn't really matter if they have new tenants lined up or not, I'm pretty sure you can just stay.

That's a crappy deal for the new tenants. I can't imagine being told I can't move into an apartment I've signed a lease for all because the old tenants are just staying. :wacko: Makes leases pretty much worthless then.

Yeah, but that's Ontario for ya. It's all about tenant laws. Which is why we started investing in real estate here and then decided to move to the US and do it.

Anyway, we talked to the apt. manager about an hour ago. She said we only have until May 31 and then we have to leave. So either she doesn't know about about the law (if that law really does exist), or she's just not telling us. Who knows. Hubby's mad at me now because he doesn't want me to live without him for 2-3 months.

I believe you can just stay in your apartment, do you know if they have it rented yet? It used to be as a tenant you could change your mind and stay and the landlord couldn't do anything about it (in Ontario). So you might be ok.

Thanks for your answers, everyone. :) I'm going to talk the hubby into just letting me go myself and getting settled until our interview. It's going to suck being without him but it's the only thing I can think of to do.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

I thought of another question - what if my husband WAS allowed to stay with me in the U.S. until the interview. Would this have any effect at the interview? Would it hinder it it any way?

I understand a separation is not a pleasant thought, but at the end of the day, if you left & he stayed...you both could work in your respective countries & make your savings pool even that much larger. Cos even if he DOES get thru...he won't be able to work. Now I know you say you have savings....but surely you wouldn't turn down some extra contributions to it?

4 months is a doddle...it'll be over before either of ya know it :)

He can go and stay in the USA with you, up to 6 months. BUT the question is if he will be allowed entry at POE!! If one was to go that route, I wouldnt be entering the USA with a car load full of belongings. Poe officer would definetly be suspicious!! What one could do is, you move to the USA with belongings, he comes down later(bus plane) or friends drive him over, and then jump into your car! lol Just ensure that he is honest at the POE. And if he gets denied, back to live with his parents until interview!!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I agree with Lisa, both of you being able to work and bank some money if possible for a cushion on the other end once he is legally allowed to enter prior to being able to work.

The seperation does suck, but it isn't for long and you have visits in between if you can.

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.

Thanks for your replies, everyone, a lot of you are so helpful. :)

Just an update: we have friends whose parents own a condo they rent to students during the school year. No one will be there in the summer so they're letting us stay for June and July :D We really lucked out because I was absolutely NOT about to stay with the in-laws. I would go mad. It looks like Montreal's still on track for interviews 4 months after case completion, so that means end of July for us. Luckily the time is flying by, and we're so excited!

Now if we could just make a baby already! :P
