Marrying on a b-2 (tourist visa)

I am in the United States Military. I met my girlfriend while I was stationed in Korea. Currently i was just restationed to texas. She currently is living with her sister now in Alabama with a tourist visa. We had no intentions of marrying before we left Korea, but we want to now so she can come live with me in Texas. I'm just wondering if marrying and doing an AOS would be a good option for us. She has only been in the U.S. for about a month now. I don't want any problems to arrise that might get her deported. Will it be difficult to prove that she did'nt come here with the intention to marry me? Does me being in the military change anything with the whole process? Any help would be very appreciated. Thank you!

Hi Derrick,

My wife and I did exactly what you have asked about. It was a very nervous time, but the love we both had for each other, and the fear of being a part was just to much. We took the chance to file for AOS while she was here on a B2. By the time we had submitted her paperwork her I94 had expired. We have since filed, and had biometrics appointment completed. I felt very good with our completed application, a lot more confident after I looked at it all together. The paperwork is lengthy, but with you being military, you understand all about government forms. I was prior service as well, so just don't miss anything. Read everything over and over. Ask questions. Use the tools on this website, and all over the web to make the process as easy on yourself as possible.

We are expect my wife's EAD to arrive next month, so we will apply for SS# and then move along in the process. Patience is the key. Patience and a lot of prayer.

She's only been here a month and she has family here. I think it would be very difficult to prove she came here without intent.

But having said that, I think it would also be very diificult to prove otherwise.

Like YuandDan said, read the guide. Know the risk then make a decision. I think this is your call.

My 2 cents, if I were in your position, I'd send her back and file K1. If I love someone enough, I'd wait. Whats six months to a year against a possible lifetime ban. Just my opinion.

What do you mean by "she is living with her sister..." Did she come here with the intention to stay? or do you mean that she is currently visiting her sister in Alabama?

i am adjusting from B2 visa myself. but my husband and i got married 5 months after i came here in the US. from what i've read, if you guys get married too soon, it could be visa fraud. we just had our interview last friday. my GC won't be sent unless i send some docs.. i'd say it was semi successful. as for proving the intent, it wasn't asked during our interview.

Yes one advantage of adjusting from a K-Visa, is the odds of not having to interview for AOS is good, however if you adjust from a visitor's visa, the odds of getting approved without an interview is low. They almost always interview for adjustment from a visa other than a K-Visa.

I was sort of asked about intent. The IO asked me when I entered the country and then stated "so you came here to get married?" to which my husband and I replied "no" and explained our situation. I was never asked to present proof of this though I had things like a letter from my landlord, letter from my mom stating how she had to pack and store my things and a letter from my employer.

Seek a consult with a competent immigration attorney. He or she can help you intelligently weigh your options. A consult usually doesn't cost much, and it doesn't mean you HAVE to hire that person to process your paperwork.

Make sure they specialize in family based immigration law, not employment or student immigration.
