Hi All,

I'm about to resend my I-130 for my wife (my last one was rejected because I put a foreign address as my residence. Technically, I'm living here, but I guess not "residing" here.)

Anyways, on Section D, question 2, should I answer yes to having filed before? Like I said, the last one was sent back to me saying that the address needs to be within the United States, not outside of it. Is that considered "filed" but then rejected?

Also, one other thing (two actually).

if for part C, q.21

(If filing for your husband/wife, give last address which you lived together),

Is it safe to put that I'm living here from DATE to Present, while listing my address as my US address? For purposes of residence, do I technically reside here (only have visiting relative Visa, extended twice for 3 mo's each. China is near impossible to get permanent residence) or is this just "visiting", and thus not a place I'd list as residing?

Another question, if I mail it straight from China to the USCIS lockbox, with China as a return address, is that safe? Or will it not be sent back to me, as it's an overseas return address?

C 21 is ok as you indicate but you might want to indicate "visitor visa" on the form or the cover letter to explain. I think mailing from China is OK but if it's not too inconvenient, I'd send it to a US address and have somebody mail it on for you, just to be on the safe side.

you dont have to say yes for the question regarding already filed i-130, because your form rejected(not filed yet).

you need to give the last address wich you lived with your wife together, however if you filing the g-325a ,if you live in china for more than 1 year you need to give that address.

for you last question it depend how long you staying overseas.

what are you filing for? how long you been in china..

We're filing for CR-1, and I had another question about that (sorry for so many!)

Aside from the I-130 and G-325, as well as the marriage certificates (and notarized copies), my passport/birth cirtificate copies and her records, what else (if anything) do we need? I'd just hate to mail it (again...), only to have it show back up three months later (...again...) due to something small we forgot :(

K-3/CR-1, I mean. As I understand, they're essentially the same.

No, they are not the same. The CR1 is an immigrant visa by which the immigrant spouse arrives in the USA with permanent residents status, work authorization and almost immediate SSN. The K3, aside from being currently practically unavailable, is a non-immigrant visa category by which the spouse arrives with leave to stay two years. They must apply to adjust their status to permanent resident and apply for work authorization, then apply for SSN. K3 requires two petitions be filed consecutively. CR1 is the visa you are petitioning for when you file the I-130. Before filing the seconcd, I-129F petition, I suggest you read the numerous current threads discussing the coma or death of the K3 visa.

beside the list you will find above, include also a ( no impediment for marriage) if you got one at the us embassy overthere. its not required but it support you petition.
