Well, here I am again.Just a brief background tale, so you understand my situation.

Our NOAs for AOS, EAD and AP are dated December 22nd, 2005. We got a RFE in january, to which we replied immediately (so our AOS date changed to 1/26/06). Got biometrics done in February 7th, however our case was not touched (unlike most people's) after biometrics. The USCIS website keep showing the same old dates. Now, I got the interim EAD, and started working, but that card is valid til August 1st, 2006. My job implies travel outside the US, and even though my boss is being VERY patient, it is part of the job, so I may be at risk of just being laid off.

Under an immigration office advice, I sent a letter to the MSC to request the expedition of my AP. That was like two or three weeks ago, and NOTHING!....

We called about a month ago to the misinformation line, and they said that they were working on the case, that in a couple of weeks I should have an answer... and NOTHING....

So, besides wait... is there something I could do so try to find out what is going on with my case? How long are you supposed to go without bugging them? I remember someone mentioning the Ombudsman on the K1 forum, but is this good for AOS too? Should I go to my Congressperson? what is to be done??

I cant even imagine that after waiting for me for 3 months to start working, in August I would have to go to my boss telling her that I cant work because the paper work never came thru. Not to mention the financial impact in our lives...

Thoughts, advice and good thoughts are welcomed....

You could make another infopass to see if there is any news.... but to be honest you have not had to wait that long there are some who wait much longer....

You took a job that involves travel yet you knew you would have to wait for AP and AP does not gaurentee re-entry to the States you could still be refused...

Yes, that's true. I could go to my DO again, and they will tell me what they always tell me, that the last date it shows in their system is Feb 7. And there is no way they can tell me what's wrong with my case, because they are not the one handling it.

As far as the job, I guess you're right. I could've gotten a job that didnt require travel, but its not like I started yesterday on this professional path, travel has been related to my job all the time, it's what I have experience in, and where I could get a good pay at.

I understand that AP does not guarantee a re-entry, but I have never overstayed a visa, I have absolutely no criminal records, and I would be travelling with the proper business documentation, I dont see why they would deny me re-entry. However, I guess its a risk I will have to take.

Are you here on a K-1 or K-3 visa? I would assume a K-1, since you are asking for AP.

05-09-2006 USCIS Site states that EAD was approved.

07-26-2006 AOS Interview - APPROVED.

07-31-2006 Received WELCOME letter in the mail.

07-31-2006 Received E-mail -- Card is on the way.

08-05-2006 Received Green Card -- Good for 10 years.

I'm curious to know what your job is -- sounds like an interesting one. If you don't mind sharing?

The ombudsman, from what little I have heard of the position in the AOS forum, appears to be a universal waste of time and effort. No one here appears to have had any sort of success with them, so I would probably put that at the bottom of the list of possibilities.

Your congressperson is a good place to start, I think, if the Infopass and the district office aren't giving you any information. Take any and all correspondence and complete a simple timeline in Word or something, print it off for their reference. Then see if you can get an interview or however they prefer to set it up. Talk to your congressperson and see if they can do any inquiries for you.

I used to be an external auditor/consultant and now I am working as the internal auditor for an international corporation based here in Pittsburgh. As I said, they have been SO nice to extend an offer even when they knew I didn’t have my EAD card, and waited patiently for me to get one. Now I have it, and even though I have been traveling here in the US, there is SOME, not too frequent international trips (Germany, Italy, Sweeden), and still, even though there is a trip planned for Italy in May, they are partially OK with the fact that I might now be able to make the cut.

I just don’t know how much longer their patience is going to last… makes sense? And then, there’s the fact that I simply love my job, they are paying good money. And not knowing what’s going to happen is making me sick with stress…

I’ll find out how to contact my congressperson and see what they can do for me…

I would say get an AP and then travel all you want - it is connected with your job - you are not abandoning your residency - I will be willing to bet that you will never be denied entry here. Go for AP and try getting your congressman involved. I think you are in very good shape compared to many others. Good Luck

Were you able to get your interim EAD 90 days after 12/22/05, or did you have to wait until 90 days after 1/26/06, due to the RFE?

I waited 130 days for my AP too - and I am sure my RFE is what messed it up. We got the congressman involved - and they ended up just as frustrated as us. Once Senator McCain was involved it was 10 days until I had the document in hand. Maybe a coincidence.....but I was sold!! I totally understand your desperation to get the AP and I would go down whatever path you need to to get it. Check out the website of your congressman and senator - there are usually instructions on what to do. GOOD LUCK!!!

Hello... and thanks for all your replies...

I got my interim EAD 90 days after the NOAs... actually like a week before (and I think it was because I had been to the DO like 3 times before and had explained about my job offer before). Pittsburgh DO has been very nice to me, and I cant really complain, and I understand that many people have waited much more time than me...

But I cant help to see the unfairness, and stupidity of not trying to pressure a bit... and risk losing my job...

I'll definitely try the Congresperson here in Pitts, and see if they can help me...
