i'm abandoning k3

Hey gang,

Just checking in to say that i decided i am not going to send my 129f in. with all the confusion about k3 being cancelled i am not taking the risk. my i130 was received nov. 1 and i was told initially to send 129 after receiving noa1. well, i got mine in february. an aide for my congressman spoke with uscis finally and told me we may be approved as early as june.

so, right or wrong, that's what i'm doing, waiting for cr1.

i just wanted to say thanks to everyone for your support and good luck to all. i'll be in cr1 forums from now on.

Actually the CR-1 does not take much longer to get through Guangzhou, maybe a month or so longer. CR-1 has the added benefit of work auth, green-card, and able to get SSN. K-3 has to apply for AOS and EAD, and wait 90 days or more for the EAD before they can do things like get SSN, JOB, driver's license.

AOS also costs $1010.

Lastly, I highly recommend that you Join "A Candle for Love" that site is the best for preparing you for Guangzhou.

I'm with you on this point .... and am only going to be concentrating on CR1/IR1.

We're not convinced that the K3 is going to get through quicker at the moment either .... so we're not sending in I-129F.

We've also spoken to the local Congress office too .... and when we told them it was supposed to take a year for my visa, they said it 'won't' and infact stated '6 months, visa in hand' .... am not sure if they have their facts straight (may have confused '6 months visa in hand' for '6 months to approval'), but this was following contact with USCIS .... so, maybe there is going to be sudden movement on all I-130's ??? ..... not convinced but we'll see.

I'm not going to hold my breath to see if what they say is true .... but it certainly gave a little bit of hope.

14 years ago it took 8 weeks for I-130 CR1/IR1 ..... (infact, I think I had mine in 6 weeks back then ... I abandoned it for personal reasons a couple of years later) .... maybe they are talking of cutting the time down to what it would've been approximately 8 - 10 years ago ..... therefore doing away with the necessity for K3 ????

There does seem to be a lot of discussion about K3 cancellations .... no smoke without fire I say.

It's just a thought .... I wonder if those who've had their I-129F K3's cancelled got a refund of their fee ????

The only K3 cancellations reported were by people who filed after there was no fee for I-129F for spouse, so nothing to refund.

Facts are cheap...knowing how to use them is precious...

I think you made a wise choice. My I-129F was cancelled but I was more upset with the time it delayed the approval of my I-130.

My I-130 NOA1 = June 4

My I-129 NOA1 = Aug 1

When they received my I-129, they pulled my I-130 and paired it up with my I-129 application. The problem is they "re-filed" both my applications under the new NOA1 date. So effectively, my new priority date for my I-130 is now Aug. 1 instead of June 4. Arg!

If I knew then, I would not have filed the I-129.
