We have completed all the paperwork for the AOS process. We used my wife's new last name (my last name) on all the necessary forms. We also used my last name for her children's new last name. Now that I am all done, I am not sure if I can change her children's last name by virtue of her marriage to me. I am trying to avoid an RFE if possible. There are many posts on here regarding using the wife's new last name on the AOS forms but I cannot seem to find any info regarding what to do for the children.

Does anyone know if I should use the children's last name as indicated on their visa, or can they use my last name now that I have married their mother? Thanks for any info.

Your wife using your last name now due to your marriage, in that you will be needing to sent a copy of Marriage Certificate. The children of your wife now, CANNOT used your last name by means of the marriage. The children could only used your last name, If your are not the BIOLOGICAL father, you will need to LEGALLY adopt the children through court hearing. If the children will used your last name, the USCIS will asked proof and it means by adoption decree order documents.

You should used the childrens name as their visa's being issued. Because whatever their names used when they entered the US, it will be saved on the system of USCIS via means of case nos. and that's how they track immigrant information online.

One example too is that, you cannot get the children a SSN if they gonna use your last name now. An SSA Officer will asked proof of identity of the children using their names. You will need to show 2 ID's or proof documents in their OLD name (as they've entered the US) and new names (after they've enterer the US).

Again changing names are only by virtue of .... court hearing for a change name or adoption.

It is true that you must adopt the children through court to be able to change their last name to yours or when they apply for their US citizenship. I changed my name 18 yrs ago when I'd applied for US citizenship.
