Hello,

Good day!!!I'm a new member of this site and have some question..I came here as a K1 visa and I have a 2 years conditional permanent greencard and it will expire next year.I was divorced now for almost a year..my question is..Is the immigration will give me hard time when i file for the I-751 or there will be a problem if i get re married again from my present boyfriend?all the advice and suggestion i will appreciate..

If your divorce is final, you can file I-751 at any time, you do not need to wait until within 90 days of the card's expiration. You need to indicate on the I-751 that you are requesting a waiver of the joint filing requirement.

Yes,my divorced was final.Do i need to get a lawyer when i file for I-751 and what are the requirement beside the divorce decree that i need to pass?

Aside from the decree of finality of your divorce, you will need proof that your marriage was entered into in good faith and that you and your (ex)husband share/had conjoined lives before the divorce. As supporting documents you will need to show that you shared assets (house, car, bank account, etc) and financial obligations (mortgage or rent, insurance, bills). Submit documents that show both your names. If you don't have that many that are in both your names, then submit separate bills that have your individual names but show the same address.

As to getting a lawyer, I think you're the best person to determine this. If you feel comfortable and confident about putting all the documents together on your own, then there is no need to hire a lawyer.

Thank you so much that was a big help...I'll try to contact my ex husband if he still have some bills that show both of our name.But if he can't produce 1 it is ok even just a letter from him stating that our relationship or marriage was in good faith...

Unfortunately only USCIS can decide if that is enough evidence, but I think you will need more then "some bills".

You will really have to search hard to find stuff proving your marriage was bona fide.

Contact landlords if you rented together to get old leases. Did you ever file your taxes together? Get transcripts to show you filed married-joint. I would send them some pictures, of your wedding, vacations you took together? Affidavits from friends. If your husband can't find any bills, (or you don't have any) start calling the cable company, phone company, electric & gas companies and ask them to send you old bills so that you can show you and your husband had mail going to the same address.

The burden of prove is on you to show USCIS your marriage was legitimate.

March 15 2008...Green card received in mail...so done with USCIS done for a few years!!!!!! :)

Thank you for the information.I know its gonna be hard for me especially my ex-husband doesn't want to produce anything that i need and he said that all i need is the divorced decree...

Thanks. He just turned 3, so he says some pretty adorable things too.

it's a pity your ex isn't cooperative :( but like I said, start contacting the places where you know you can get some paperwork showing you lived together, had an honest marriage. If you had a joint bank account, contact the bank and ask them for the old statements showing both your names. If your ex won't help you, I strongly belief you can still get a lot of prove yourself if it exists. Start calling ASAP!! :)

About marrying your exsisting boyfriend...you may want to consult with an immigration attorney (many of them here by me have free consultations) ask them what happens if you do, you might have to go through the I-130 process again? (petition for an alien spouse or something). Explain to the attorney your situation with removing conditions, and your option to marry your boyfriend if you and he have already discussed marriage. And then decide if you do one or the other, or both?

If you filed joint income tax return with your ex-husband (while your marriage was still in force), you can ask for tax transcripts from the IRS. That's one type of proof that you can submit to show valid marriage.

Yes we filed joint income tax last year but that was in NJ and now i lived in Texas..How can i ask a copy of the tax transcript from the IRS???

You can ask a copy by Phone or by Mail. You need to know his Social Security Number in order to get the tax transcript. But If you have a copy of the tax return filing jointly, you don't need a tax transcript.

I have a question,when i got my final divorced i moved to Nevada but i didnt change my address and i lived there for 7 months.Now i just move to texas and 2 weeks ago i changed my address online and got a confirmation...do i get a letter from USCIS telling that my address is change?thank you for all the replies i really appreciated.This site is really a big help!
