Hi Everyone. My fiance (now wife) entered the US a couple weeks ago on 02/11/08 on her K1 fiance visa and we were married yesterday. Today we went to the Social Security office here in Tacoma, WA to get her a Social Security number and were told that we should have filed for it before we married. I've heard and read different things on this now. The USCIS agent that processed our K1 Visa at the border when she entered the US told us we could marry first, then apply for the SS number. The K1 Visa expires April 8, and the I94 expires on May 10.

The agent at the SS office today told us that she could not get a SS number with her K1 Visa because the K1 Visa is no longer valid as we are no longer fiance/fiancee. He said that we would need to adjust her status before we can get her SS number, which could take a couple years. We certainly cannot wait that long to get her SS number.

So did we really screw up by marrying before filing for the SSN? We can't be the only ones to deal with this.

Any advice would be greatly appreciated.

You can get an SSN, but you do need to make sure you bring your marriage certificate if your wifes name has changed.

Best thing to do is try to get someone else or speak to a manager.

Each Social Security office seems to have their own set of rules set by ignorance of the law. The bottom line is you can get your spouse a SSAN before you get married and of-course after your married. You do not have to wait to adjust status. I wish I had time to look the laws up for you, but I am at work right now.

I got my wife a SSAN before we were married a couple of weeks after she arrived. We just got her green card and now we are going to get the name change completed.

Good Luck

Print out the link in my signature and go back to the office. Ask to speak to a supervisor if you must. There is no reason a K1er cannot receive an SSN after they got married.

That is indeed the location we went to in Tacoma, but what is the significance of that?

Do you know something about this branch? Is there someone in particular we should talk to?

Thanks,

Rob

I have the same exact problem and I was told that we can no longer apply for the SSN because my wife and I were already married.

I printed out the

what should I point out when I bring this to the SSN office?

I tried to read this document many times, but I cannot understand it.

Thank you.

Go to another SSA office and apply for SSN under maiden name. Don't tell them that you are married. Others did this and it worked for them.

@doc

I am sorry to hear your story. I went to SSA in CA yesterday as well. We also got married already and had no problem. I had to show my passport with K-1 visa and I-94 as well as our marriage certificate (to prove the name change). As recommended by VJs step by step guide I had printed the RM 00203.500 and took it along, but did not need it. The lady handling us seemed well informed, after she input my data I got a form to sign and a receipt and was told that I can expect the SSN in about two weeks.

My understanding is whether married or engaged, our status is K-1 until AOS is approved.

we went in before we were married on the K1 and told we could not get one. We were told that we should apply for EAD along with AOS (which is free anyway) then once we have the EAD we can bring it in along with passport and obtain a SSN just like that. Without permission to work i'm not sure why an SSN would be needed anyway, but hope this helps!
