January filers VSC lottery, who gets the jackpot next?

So... I broke down and called the RFE line today.

I shouldn't feel bad, since we actually DO have and RFE, and it's been more than the 14 days promised in their notice (but less than the 60 days they say to wait to call). Here is what happened:

I followed the prompts and ended up speaking to a very cheerful woman at the VSC. I introduced myself and told her that "we had gotten a Request for Further Evidence and had sent it back a while ago, but since we haven't heard anything since, we are now wondering what the heck is going on with our petition".

She took my receipt number (the EAC number) and looked us up on the computer. She was VERY happy to tell us that "the case was sent back to their desk on April 14th, which means that you can look forward to having a decision in the next few days." (I then asked "Who's desk... the adju..." She cut me off, laughing, "Yep, the adjudicator's!")

Now... I was never one to believe in the whole "RFE Trick" thing, and I still won't say I do, but it seems a bit fishy that 'just yesterday' our case was sent back to the adjudicator.

So basically then... our case has been sitting in a box in the mailroom since March 20th. I made sure to write RFE in big red letters on the envelope, and they opened it and updated out status as "Evidence Received, Case Processing Resumed" when it was received. It was just never handed off to our adjudicator, so they could finish out our case. GRRRRRRR.

But, hopefully we do get a decision in the next few days. HOPEFULLY.

I hope you get it this week!!!!! It doesn't surprise me though about them, getting it, scanning it back in, and letting it sit ... just goes back to the idea that there is no real accurate process to what they do.

So I went and told my SO about the call to the RFE line, and now he is all stressed out (which is making me stressed out) about the petition being approved before his trip here in a week and a half (we are beyond worried about him getting turned away at the POE, but it is a chance we decided to take).

Now he feels that an approval so close to his trip would seem suspicious. I say no, because it is all up to what mood the immigration officer happens to be in. It also didn't go over well when I told him about the recent thread about a fiance making the one-way trip to the US with a K-1 in hand being turned away for making a joke to the IO about 'maybe not having the nerve to go through with the wedding (or something like that)'.

As I've said so many times before... nothing goes easily for us. Ever. So I can only expect the worst.

And that makes me EXTRA SAD.

As long as he stays cool and can show proof that he's not planning to make the move now, he should be ok. Just have him bring some ties back to his home country..

I know it's easy for everyone to say "don't worry you'll get your NOA2 soon" but....atleast you know it's with an adjudicator. I hope you'll have it soon!

I think there was somebody who went to visit the USC beneficiary close to approval and they were ok... or maybe you could check with Miss Yoko, she just visited her SO in chicago a few weeks back and was able to spend some time with him.

I just hope everything will turn out for the best for you both.

Psiprez, dear, we are in the same situation. I read your timeline and it is exactly the same as ours. We sent our Petition (K1) on 8 January, sent our response to RFE on 31 March, case was resumed on 9 April, touched on 10 and 11 April. Nothing else as of last Friday.......Still waiting.....I wish us all have NOA2s soon!!!!!!!!!!!!!!!

Amanda, would you please use your "angel's tongue" and wish us too the long awaited approvals??? Pleeeease

Oh, yes, Psiprez, I have visited my fiance in US this February (I mean since the time we sent our Petition)...and it went well... make decision if you really need to go at the moment, but in general your trip is possible legal wise.
