Still have little question about ITIN/W-7

Hi VJ fellows,

As I read many posts about tax filing here, you guys suggested that if do not have SSN yet, we may fill in one more form (ITIN/W-7) for filing tax jointly.

Well, I don't understand how to answer some questions for this form:

1) Options a - h: Am I

<a> Nonresident alien required to obtain ITIN to claim tax treaty benefit?

<c> U.S. resident alien (based on days present in the United States) filing a U.S. tax return?

<e> Spouse of U.S. citizen/resident alien??

2) About the name: 1a is my marriage name? and 1b is my maiden name?

3) Type of U.S. visa: do I just said K-1 and fill in the expiration date which on 12/11/07?

4) My husband wants to file his tax by H&R Block (which is e-filing), how will it work to attach with W-7?

Sorry to ask so much questions, but it annoyed me and my husband a lot, he started to think silly that the US govt wished to trick us, and not paying back the $1200 to us as a married couples...

Doesnt H&R Block knows how to file with the W-7? My husband and I are going to use that too and I was hoping they will assist us in filing jointly and with my daughter as dependent. I have not called them yet and I'm just reading posts here so as to know experiences of other people who has been through this.

Cause we are doing it by ourselves online, we haven't found any accountant or expert to do for us.

And I'm reading other forum, some said my husband can file the tax with my Alien #, but I'm not sure how it works and where I'm supposed to fill out that number.

If you look on the site for the tax (internal revenue) there is also a listing of what they call agents, you can look for one in your area and call them. THey are supposed to be experienced to help with getting these numbers.

Ohhh good to know!! So this year he can't file tax online, and have to mail out the forms?

Single $600 and who has kids can get $300 per kid (Correct me if I am wrong)

Right, so we are still struggling whether to use W7 or waiting for EAD/GC to get SSN...

But the deadline is coming closer, if we didn't file the tax before Apr 15th, then my husband will get in trouble...awww....

your filing options (a-h) depend on your situation. Do you live in the states? Is your husband a citizen? If your husband is a citizen or has a tax number (either ITIN or SSN) then you would choose option E. You would only choose option C if you are filing single or are the primary on the tax return. If you have a US Visa, you could possibly choose option G. Your safest bet it to go with E though.

Yes, 1a is your current/married name and B is maiden name.

Type of visa: You need to attach a notarized copy of your visa AND fill in the information on the form.

H&R Block actually has agents that can do the form for you. But it's something you can do yourself.

Remember that if you use a ITIN, neither will qualify for the tax break this year but it may be claimed next year, I believe if both have the SSN then. Your husband could get $600 with you on the ITIN but only if he files married filing single which may not be benificial.

This will be something to ask the tax people about.

The IRS website has alot of information on its site about who is eligible.
