I i am an american citizen, and i got married to an undocumented mexican women, i filled the I-130 and got an approval letter last week, i was wondering if anyone can give me some advice. I had an exspencive lawyer prepare the I-130. But im confused, & excited i herd that i shoud fill out an I-129F and get approved so i can qualifie for a K3 in Juarez, MEXICO, this is my question what are my chances of not getting this aproved in juarez and not being able to come home with my wife. I know this is hard as it is, she cam here when she was 5. illegaly and we just want some normality. please help, or give some advice, should i try this I-129F or not bother, she got a mexican passport last week from a mexican consular. thanks to anyone who here's and can help

Firstly you posted this to the K-1 forum which is fiancee, you are talking about I-130 which is spousal (Married)

If you have an approved I-130, the K-3 is no longer an option, you file the I-129F before I-130 approval. ANd you cannot file I-129F overseas (DCF) K-3 is only an option when filing I-130 and I-129F to USCIS in the USA.

You may have to file a waiver to overcome the bar that may exist, you file the waiver upon the request of the counselor officer that does the visa interview.

Stick with the I-130. I-129f {K3} at this time is expensive and a LOT more paperwork and stress.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
