it has been 21 days since i had the bio and the touches,but still nothing ,i keep checking the mail,uscis site.... but nothing yet.It is going slow i was thinking things are faster for march filers.

Just a little more patience dolphin1! It will come soon and as what I am seeing with the progress of February filers the movement is reasonably quick compared to previous experiences. Hang on tight! We are next in line

Well guys!! tomorrow is BIO appointment day wish me luck...I know there's really nothing to it but not everyone gonna get that "really smooth, out in 20 mins" experience so I'm just hoping that I will be one of those lucky ones...

I have a question....I have a g/f who is going through the immigration process as well she filed late Feb and she told me she recieved RFE in the mail for her I864EZ...I couldnt answer her question because I havent got any RFE not yet at least...I notice that you got RFE for the same form I864......she had submitted the I864ez but they say her husband didnt make above the poverty line eventhough she filed with a joint sponser....her concern is her husband only have 2 recent tax return for 2006 & 2007 but not the 3 that they ask for on the form!!....the question is can she resubmit the I864 as required with only those 2 years w2s and transcript or she has to submit all three 2005,2006,2007??

your advice will be highly appreciated

P.S she was misinformed by USCIS customer service about submitting the I864EZ with only the most recent year tax return which would be 2007 and nothing else!!

it was same situation with us, before we send only 2006 1040s, but they asked for the most recent tax and pay stubs from my husband... so we send 2007 1040s only (don't worry about 2005) + letter from his employer + ex-employer with RFE... as he doesn't make enough we put his sisters I-864, but it was in the begining... so RFE came only for the main sponsor, and not the so-sponsor...

So in this case she doesn't have to send all 3? only 2007 & 2006??...should she leave 2005 blank?? she told me she sent only 2007 and a co-sponser the first time around...I want to know if she have to resubmit a I864 for her co-sponser?? she did on the first submission but concerned that she have to do it again.....!!

What you need to include is:

-the entire income tax return for 2007, and the W-2

-6 months of paystubs

-employment letter

I also included the W-2 for 2006-05-04 but thats optional.

And you do not need to resubmit the I-864, just attach the required info to the RFE, and you will be good to go!!!

Is the employment letter necessary?? because her husband's employer is reluctant for some reason...they ask for it before they filed previously but still nothing....im thinking he's not asking on a daily bases but I will tell her to have him try again!!
