Okay...I have some "news"... My husband and I called USCIS on conference call yesterday because i've heard many times to keep calling. Anyway, so we get this regular agent who tells us that she is going to escalate our call to a more senior agent who has more access. (I had no idea there were different tiers of agents on the hotline) The senior agent was a woman and very nice. She asked us all kinds of questions and asked why we didnt file a service request. I told her that we were only 20-something days over the processing times and that other agents have said the computer wont let them do it until it is 30 days over the processing times, which she then confirmed was true. She then looked into our case and told me that the case had been placed "on hold". I'm assuming its been that way since 6/23 which is when we got the last and only touch. She also said that it had not been tranfered anywhere yet. She said there wasnt a reason as to why it was on hold although occasionally a reason is given. According to her it could be a variety of things (as usual...) One scenario she threw out was that so much time had passed they were just going to schedule the interview and bypass the EAD. Another reason she said could be because his birth country is South Africa which may or may not be cooperating. Or who knows, maybe they think we're the biggest liars ever and theyre going to send him back to Canada. But heres the best part....she told us she didnt think it was right to leave us speculating about the millions of reasons it could be on hold, especially since its already been so long. She said that there are many different categories of service requests that can be put in and she put one in for us in a way the computer would allow! So hopefully we will get a letter soon explaining exactly why its on hold and if theres anything we can do about it.

E-Merce, I have been following your case because I'm in a similar situation (day 90 - today and absolutely no news on my EAD!), I really hope that you hear something soon!! I worry now that my infopass won't do anything for me, since it is not going to be 30 days past the 90 days limit. But I'm going anyway and we'll see.

It's so good to have the process demystified a bit! I guess they need a background check from the birth country?

I don´t think that´s the case. Or at least it shouldn´t be. I mean all the checks were done before for the K1. I don´t know why it should be done multiple times in a row. Getting the EAD is based on them getting married and they get married due to a valid K1. So unless they didn´t get married I don´t know what the big deal is about EAD and I don´t understand why USCIS is making such a hassle about it. Besides, what sort of a behaviour is this? They don´t understand or like something about someone´s paperwork so they are supposed to ask about it (send an RFE or something) and not put it "on hold" and forget about the whole thing without ever dealing with it after or informing the people that are involved.

Ok I looked at their timeline and it doesn´t look like they got married on K1 cuz it says other visa. So there might be some other problem. But the stuff with K1 can at least be applied on us, since for our K1 everything was alright so I don´t know why for AP and EAD something wouldn´t be alright. It´s just weird. I think our "adjudicator" took 2008 off ...hopefully he/she will be back in 2009 :P

Scott + Marta, we did not marry on a K1 Visa. I met him in Canada while I was going to school and my study permit and his apartment lease were both expiring the same exact week. We decided it was a great opportunity to have him meet my parents because we had been together for a few years and they had never met him. We took the bus down to New Jersey to spend some time with them but we werent engaged or anything. Then we realized he could visit for 6 months so my parents told him to stay while we figured out where he was going to live in Canada. A month or so later he proposed to me and we decided before he moved back we would get married. Then we found out that based on that we could fill out paperwork to let him live and work in the US so we decided to go that route. We had a lawyer prepare the papers and we mailed them out in the middle of March.

I definitely understand how that could lead to the checks being done now, but the question is that if thats the case why are there quite a few of us (K1 and Non K1) that are all in the same position? It just seems like they are backed up overall.

Hey guys sorry for the delay with the update on my case, the internet was down for a couple days!!

OK...here's what happen, my husband and I left our home at 4:45 am...it was my idea to leave way early because my husband is always getting lost....I called him the "lost God" :lol: .. Anyway we got in Denver at exactly 5:45am, drove around to find the building,we pass it once!! didn't see the BIG 12000 on the poster!!

We stopped at Mcdonalds and had break fast..then we head back to the building...enter at 7:00am go thru security, the whole nine yards...we were the first to arrive but after about 5 or 10 minutes people started coming in. We sat for about 10 minutes before my name was called!!for some reason I wasn't nervous at all...more anxious though!!

My husband and I was greeted by a really nice IO in her early 30s, she was really approachable and immediately I felt comfortable...she led us to her office swore us in and then proceed with questions. she confirmed what I had on my I-485, she asked me my husband's birthdate, our address, when did we get married, if we have any children, the YES & NO questions etc... she only asked my husband 2 questions: his SSN and if he's still active duty in the Army...then she said "dumb question" obviously he is, as my hubby was in his uniform :lol::lol: , as she continue she asked if I have anything for her, due to the fact that I sent most of the evidence we had with the first application, all I showed her was pictures(commenting on how beautiful our daughter is :P ), life insurance, military ID, our daughter's original birth certificate, and a copy of our joint account and as I was handing it to her I explained the suituation with the statements and she said thats fine ....At the time when I filed I used my maiden name instead of my marriage name so I asked if it's possible to change it and she said yes!!..Then she told us that all my name checks has been cleared so everything look great so she is going to go ahead and APPROVE me, then she explained the removing of conditions and gave us a form explaining how to do so and the possibility of a waived interview next time around and so on. I was so happy when I left the room smiling from ear to ear...but Im still in denial I have to see the actual card to believe that it's over for NOW!!

Just get a chance to check my email because our internet was down, and I got the email from CRIS stating that card production orderd on the 29th!!

sorry for the long post just wanted to give you guys specific details of my experience!!hope it will be helpful for those who have interviews coming up...GOOD LUCK and thank you guys for ur advices & encouragements, I am really greatful!! :thumbs::thumbs:

For us, it's getting so DEPRESSING...nothing yet....absolutely no activity on our I-485...no touches, nothing...our file is dead. I'm starting to seriously worry...are there more of you out there like us...???

I think there's heaps of blokes out there who are in the same status as we are. May the force be with us!!!

You are certainly not alone in your journey. I had not received any updates since the biometrics appointment back in April, so I decided to call and find out what was going on. When I called the USCIS phone number and entered my case number, I was told we had been sent a RFE. When I spoke with a live person, they could not tell me if an RFE had been sent or not. They said nothing was showing in their computer.

I never received an email from CRIS or anything by snail mail, so I have no clue at this point what is going on, or if or when one was sent. The USCIS rep. submitted a form to find out what was going on but stated it could take up to 30 days. Looks like this process is going to take 6 months or more just like our K1 visa approval.

Anyone know how long it takes for them to find out what is going on with your case after they submit the request for investigation????

Hi there, I would not worry. It appears there is a glitch, and many people get that recording. I even got it when I used to check the status of our I-130. When you call, using the RFE line (path)...it will tell you that you have an RFE....but you really dont. We never got one with our I-130...

I decided to call USCIS. AGAIN :P The last time I called they placed service request for the AP, today I only called about the EAD.

For the ones who don´t remember: in June they told me my EAD is set to be adjudicated on July 28th or earlier. In July I called about ten days prior to this date and that´s when the lady said she wasn´t able to place a service request for that, cuz the computer told her I had to wait 55 more days before it would accept the service request (which would put me in the middle of September).

Today I decided to call again just out of curiosity and despite the first lady putting me on hold about million times and asking my zip code about half a million times and so on, she put me through to some laid back guy who told me my EAD was still being reviewed and they were still working on it. So I said that since their website says they were working on EADs from April 16 and my one is from March I´d like to know what was going on. He said I could go to my local office (well go - that´s 4 hours driving ) and tell them to call the benefits center and they should tell them. So I said I thought that´s what the service requests were for. So he said he could place a service request but that would take up to 30 days before I get a letter from them. I said that was fine, so he placed the service request for my EAD :D

So now I have service requests on both AP and EAD :D See what happens :P
