I know I asked this the other day but does anyone know the income guidelines for the affidavit of support?

125% of the poverty line. Dependents are taken into consideration in determining poverty levels. There is a schedule I saw, I'll look to see if I can dig it up again.

Thanks.. trying to figure out how that works with my children and then Levi and would they count child support as income? :bonk:

Which thread? It might be fun to join the scrum

No scrum! I re-read what I said and it did come across as rude...I just wasn't thinking. Here. I feel really bad...

:lol: As soon as I saw it was Rebbecajo I had to laugh, she loves mixing it up from time to time. You didn't say anything even remotely approaching rude, I think she was just looking to pick a fight. Now if she had gone into a long explaination about her husbands parent's death 25 years ago and how the innocuous articles she moved over had particular meaning to her and then you said something about heritage and comic books....welll....ok. But she brought all that stuff up after the fact, which pretty much indicates her mood today. I wouldn't irritate one brain cell over this one.

And So It Begins......

That's a common question and one that I believe the answer for is yes. But keep reading on this. Support is not "taxable" so it would not show up on the tax returns, you would have to have other documentation to support the monthly support payments.

Remember it's only the USC's income that is considered. If the child support payments are to the foreign fiancee they would not count.

There should also be a support worksheet that you can come up with (mosts states use that to determine support requirements) or your divorce decree which specifies support payments. Question, do you list the kids as dependants on your tax return?

I'm not familiar with how it works, so I apologize if I'm asking dumb questions...do you claim child support you receive on your taxes? Could you include a copy of your 1040 with the affidavit? I'm not sure if they would consider that as proof, but it might be worth a try. From what I understand different embassies have different rules. Have you asked around on your regional board? Maybe someone could give you specifics on what your embassy/consulate will accept.

Child support is not taxable - it is not included as income on the tax return or show up anywhere else on the tax return as well. Alimony, on the other hand, is considered in determining income - but that is paid to the ex-spouse as support for him/her, and not as support for the children specifically.

Ohh...that must be what I was thinking of. I just remembered seeing the question about "Do you receive any other support" or something like that...I always assumed it included child support.

Do you have a court order for child support? Maybe that would count as proof of it. (I'm just brainstorming here. :) )

I think we should have this covered with the worksheet, the bank statements, and the divorce decree. Just bundle it all up, include it the copies with your tax transcripts in the backup for the I-134 and I think you're good to go.

lol...I forgot who had asked the original question when I said check your regional! I can't remember...are you going to Vancouver or Montreal? I think your bank statements should be enough. It's crazy how picky the Canadian consulates are! I've seen people from other countries who say the officer barely looked at the financial documents.

:bonk: I knew that! I've heard that they want three years of IRS transcripts to prove income. However, they'll accept a letter from your employer if you've been there that long. Basically they want three years of financial records from the USC.
