January Filers at the CSC - How are you doing?

on a different note... anyone knows how things are with taxes over 2008??

I mean, I always thought we had to file 2008 in either the US or our home country (that is if there is an agreement, I know there is one for most European countries). But now I also read different things and that we apparently do not need to file tax yet since we haven't been here long enough or something? I don't know but it confuses me a bit so now I am kind of wondering what you guys think we need to do.

On that same note... the USC's claim differently now that we're married. I'm not sure how all this impacts taxes this year. Anyone with knowledge in this area?

I'm not an expert but I understood that in 2008 we pay the taxes in our home country. Since we were all working during the long K1 wait! héhé. But not in the US, since we're all not working during this long EAD,AOS' wait! We'll pay taxes for 2009 here.

12/14/11 - Sending out N400 package

12/19/11 - Received by USCIS

12/21/11 - NOA date

12/22/11 - Check cashed

12/27/11 - Received NOA

02/06/12 - Received yellow letter (pre-interview case file review)

03/13/12 - Placed in line for interview scheduling (3 yr anniversary)

03/17/12 - Received interview letter

04/17/12 - Interview - No decision, application under further review

04/17/12 - Biometrics

04/25/12 - Placed in line for oath scheduling (so I'm approved yay!)

04/27/12 - Received oath ceremony date

05/09/12 - Oath ceremony!!

Hmm.. I just took a little look at the IRS website and then thought to myself "why not try the turbotax program and fill it out as far as possible.. it will ask questions and it might explain everything also"... well, it did hehe.. apparently we can file a joint tax return but we do not have to file our income here (we do that in our old country still).. this way the USC gets an extra exempted... without filling in any expenses, just income, my wife already got a bigger return than last year lol.. I think I'm gonna do a full return a bit later when I got all information.. theres so much stuff I need to look at with that :S

Cécile, I just did some reading and stumbled upon something you might be interested in to know, in regards to your earlier question about telling them that you are a US Citizen...

© Misrepresentation.-

(i) In general.-Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or admission into the United States or other benefit provided under this Act is inadmissible.

(ii) FALSELY CLAIMING CITIZENSHIP-

(I) IN GENERAL- Any alien who falsely represents, or has falsely represented, himself or herself to be a citizen of the United States for any purpose or benefit under this Act (including section 274A) or any other Federal or State law is inadmissible.

(II) EXCEPTION- In the case of an alien making a representation described in subclause (I), if each natural parent of the alien (or, in the case of an adopted alien, each adoptive parent of the alien) is or was a citizen (whether by birth or naturalization), the alien permanently resided in the United States prior to attaining the age of 16, and the alien reasonably believed at the time of making such representation that he or she was a citizen, the alien shall not be considered to be inadmissible under any provision of this subsection based on such representation.

No gym membership then :P No, seriously, I was just really curious because the only documents I could find said "if you lie about your citizenship in order to get a job", but I couldn't find anything about just lying for other reasons. Like if you're drunk one day and start saying you're a US citizen. :P

About driver's license... I've had my temporary driver license at least three weeks ago (well, Dec 23rd I think) and I still haven't received the normal one. For people who have already received it, how long did it take?

And on our end, still NOTHING regarding the EAD or AP or AOS. :angry: :angry: :angry: Last Friday I called and filed a Service Request since we are beyond the three months. They said we should hear within two weeks. Tomorrow will be one week and no sign of anything happening... not even a touch.

05-28-2008 = NOA2 (125 days after NOA1)

06-02-2008 = NOA2 Hardcopy received; NVC received petition

06-04-2008 = NVC sent package to Costa Rica

06-10-2008 = Embassy received

06-13-2008 = Picked up Packet 3

06-25-2008 = Interview (28 days after NOA2)

07-05-2008 = Home to the U.S. together!

01-02-2009 = AOS processing resumed

01-16-2009 = Service Request filed for EAD (90 days with no news)

01-27-2009 = EAD and AP approved (102 days after NOA1's)

03-12-2009 = AOS Interview, APPROVED!

REMOVING CONDITIONS TIMELINE:

02-18-2011 = Sent packet to CSC

02-22-2011 = NOA1 Issued

03-21-2011 = Biometrics

04-26-2011 = APPROVED!

DONE WITH USCIS FOR 10 YEARS!!

That's crazy that you still haven't gotten any of these. Especially after a RFE, one would believe that they'd want to finish your case fast. Nothing makes sense.

I'm so sorry! I totally understand you! I was in the same case! I had to wait 112 days before getting my EAD!

What happened when I put a service request, is that a week later I received a letter saying that someone is processing my case, it should arrive soon at your home!...I've been approved about 20days after my service request. And the next day after my infopass. I think you should think about getting an infopass too. ;) Things seem to go faster after that!

I agree with the previous poster, it might be an idea to get an infopass appointment.

About driver's license... I've had my temporary driver license at least three weeks ago (well, Dec 23rd I think) and I still haven't received the normal one. For people who have already received it, how long did it take?

I think that is also various per state.. in Hawaii you get it right away, after the examination it took like 2 minutes to get it (both times, with the permit and the license).

Nevermind I just received it today! It took a month!

They are still saying the same thing (application pending standard process at USCIS office), but the date is different. That's awesome!
