Man! You both lucky with that!

I'll say I am lucky when they give me the license. Until then, I'm still pretty sure there's going to be a last minute problem...

And last time I call, the lady let me talk to the supervisor and he said that I was illegal, K1 doesn't exist. Only K3 allows me to drive and to be married to an American!!! :huh:

Wow that's big BS! You should print something from the USCIS website to show them that K1 exists. Did you call the Department of Revenue? They will know if you can or can't get a DL while adjusting your status (since it varies for every state) If they tell you that you can, ask them what you can do to prove the DMV office that you can. That's how they told us that they will have to call the Fraud and Immigration department if they want to know the truth. But from what you say, I have a feeling that they won't even try to call them, they will just continue saying that you can't... Are there several DMV offices around where you live? maybe you should try a different one.

The people you need to call would be the Department of Revenue in the state capital.

You live in Colorado, right? I found this: Identification to get a DL but they don't talk about adjustment of status... so I don't know if you can get a DL for sure, but the department of revenue should know.

I just called them for an hour. They said I can't! : ( They need a valid I94. the woman told me to get my I94 extended! I don't think it's possible!

I have to wait for my EAD. But at the same time, she told me that I should try to talk to the manager at the DMV of my city...

Phew! I am exhausted to talk with them everyday! I give up! <_<

I don't know yet when I'll try to pass the driving test. I'm trying to figure out how to do that, Bryan doesn't have a lot of time off work anymore, and I'll need someone to drive me to the test. So I don't know!

Well, at least now you have an official answer to your question, even though it certainly isn't good news.

I don't know yet when I'll try to pass the driving test. I'm trying to figure out how to do that, Bryan doesn't have a lot of time off work anymore, and I'll need someone to drive me to the test. So I don't know!

In one hand, I am mad at the CO DMV but in the other hand I understand why they want to see an EAD...

Here's my question: What if tomorrow there is a police control and wants to see my papers. I show them my passeport and the I 94 is expired. What proof can I show them that I am here legally? I don't have any documents. And the NOA of AOS is not sufficient. It shows that I asked USCIS to adjust my status, but since I am not approved, why am I here in the US?

Our status is hard to understand! :wacko:

Is your instruction permit good only until your I-94 expires, or does it work like a "normal" one?

It's valid until 11/04/09, so I can keep it for a year until it expires, they didn't even look at the I-94.

Sorry to hear the rest of the DL is causing so much problems.. it's odd to hear that some areas are so easy with the DL and some others are making so much troubles. Have you been to a different DMV also or not? I know, for example, that there are 4 DMV's all within 10-15 miles radius for me. Maybe changing location might help too.

Man! You both lucky with that! Me still nothing,I try pretty much everyday to convince them, but it's getting worse worse!

That is exactly what I worry about at times, that is why I am happy to have my instruction permit now and hopefully soon my DL, that way I don't need to carry my passport any more as it is sufficient to show a legal status (kinda odd too since I could be rejected but my DL could still make me be here semi-legal then :S ).

It is also the reason why I wanted to marry ASAP after my POE, so I could request everything while still being in status. I hope the NOA1 will be enough proof (and a bit later the AP and EAD) for them when something indeed happens.

It is an odd situation indeed... you basically go out of status, become illegal in a way (thats probably why the DMV has a problem with your case) but still being legal.. I can imagine some people having problems with understanding that.

Sometimes I wonder if a DCF wouldn't have been easier as you get your GC while youre still in your home country.

I did.

The first office said "No way"

The second office said "OK" the first time, then "No, that doesn't work" the second time.

I could have gone to the other 10 offices around here but they will probably all look confused :P

Hi guys!!!

I use to post in the February thread. I just wanted to tell you that all goes fine for Gally, Richard and I. We arrive in the US, October 30. All was really easy at the POE. Gally even received an American Flag pin from the POE officer.

We was there just in time to celebrate Halloween! It was great! Gally had a lot of fun doing "Trick or treat", me either as we get a really nice neighborhood. Richard and I we gave something like 250 handfuls of candies.

We went Monday to the county office to get our wedding license. Today it was Gally's first school day. She was really wonderfully welcomed at the school. She came back from school highly excited and happy.

As I can't work for now, I will ask the school about their needs for volunteers.

Saturday we will get married. I can't wait!

Sorry, I am a little late, but I don't have any internet connexion right now! :angry:

In my case with the DMV, there is only one, and it is an hour and half away! I went over there with my NOA and the biometric stamp on it, but they say I will need my EAD or CG.

I am not so concern about it anymore, as I am not driving except to go to the post office. I live in the middle of the woods, and the deers are everywhere! There weren't jumping on the road yet, but as the hunting season started, they will be jumping for anything! Plus, the snow is coming now, so I won't risk to drive right now without a Minnesota license, and it is ok because I am a little afraid to drive at that time of the year! :whistle:

Hello everyone, I have surely missed all the great happenings here but I am glad everyone seems to be moving pretty fine even with few glitches here and there. CONGRATS on all the weddings and all the other happy reunions.

I may have been a VSC filer but January CSC has been my second home here on VJ. Just an update on us, arrived here in Johnston county, NC on Sept. 4, got married Oct. 18 in a small and private church wedding. My step-daughter did my hair, I made my own bouquet and also did my own make up. The wedding was very simple but it was beautiful, my mother-in-law said there was no dry eye when we exchanged our personalized vows especially when we gave our vows to our kids. It was not what I visualized our wedding would be but it had been more special and memorable than I expected it to be even without the glitz and glams of a fancy wedding.

On other note, we tried applying for SSN last week and was told that I am not eligible to get SSN since I already got married and therefore the K1 visa SSN eligibility don't apply to me anymore. The lady we talked to said we either need to do the whole process so I could get a K3 visa (which absolutely don't make any sense to me) since I am a spouse of the US citizen now and not a fiancee or we could apply for EAD for me and also for the kids. She was telling us all this probably not knowing that EAD cost $300+ to get. Anyweiz, we will try to go back to SSN office this week and try our luck in getting the SSN again.

dbears, I just posted in the VSC thread (I didn't see that you posted here too), unless I am not aware of something, if you apply for EAD at the same time as AOS, there is no additional fee, you just pay the $1010 for AOS and that's all.

As for the SSN, you are eligible. Apparently it really depends on who you talk to at the social security office. When I went there, they were not sure I could receive an SSN because I was already married and therefore my name would not match the name on my immigration file, but they sent the request anyway and a few weeks later I received my SSN, in my married name (I had other problems, my I-94 didn't match my name in the SSA system, but apparently they figured it out correctly in the end).

You should ask in the "Working & Traveling prior to getting a Green Card" forum if you haven't done it already. There was several documents there that showed that K1 visa holders who got married could receive an SSN. I had printed them and brought them with me at the office just in case, maybe you should do that. In my case though, they didn't ask to see them.

Good luck with those steps :) It sure isn't easy but in the end everything will work out right.
