Jeroen, I am sorry for you... I wish there was something we could do. Make sure you give them as many details as you can in this email. I hope that they will give you an answer soon (and not make you wait several months like CSC do) and that the answer will be a positive one.

I really really hope my mail will make a difference and that I will get approved real soon. All I can do now is pray. I left the consulate with real pain in my heart after I heard the news and had a hard time not to cry either (kinda did happen when I drove home tho). I cannot really explain the feeling, it's like a really empty feeling... to know that you were so close to the visa and to see it being taken away from you really hurts (even more because it all happened more than 10 years ago and what happened was really minor)... I really hope none of you guys will have that problem and that you guys will get through the process real easily. Then again, I shouldn't let hope go as of yet... like the consulate said: it is on hold, it is not approved nor is it denied.. I am still eligible to get the visa they said but they need to be sure about what happened back then which I can imagine also but yah, it is painful too :(

I can't help but cry while reading your post too. :( I feel so sad this should happen to you.

But the good thing is, you were not outrightly denied so you are right, you should not let go of hope yet, there is still great hope that you will get that approval once you sent the new translation and the email. "God will make a way when there seems to be no way." If it is God's plan for you and Michelle to be together in the US then your past can not stop it.

I hope you and Michelle will continue to hold on strong. I will keep you both in my thoughts and prayers. (F)(F)(F)

Man, I'm so sorry to hear the news, I know that the feelings of hopelessness are probably a little too much right now, but I know you've got the strength to pull yourself through this. You may want to hire an attorney to get the court to clarify the circumstances around the incident (it seems there is an exceptional amount of confusion in the documents or police report). If you have been an otherwise model citizen, who just happened to have the wrong friends this one time, perhaps your or your attorney can get the judge (or any judge) to write some supporting clarification. I don't know what options are available to you, but I just want you to keep fighting to get through this and not to give up even if it takes time to get everything cleared.

Be very careful what you write to the embassy - as the saying goes "what you say can be used against you."

Thanks for the kind words everyone.. I send out the email last night at around 1 am Dutch time.. I have been working on it for quite some time so I would put together a nice composed email.

You may want to hire an attorney to get the court to clarify the circumstances around the incident (it seems there is an exceptional amount of confusion in the documents or police report).

I have asked one of my uncles, who is a retired lawyer, about what the reason could be behind the confusion and such. This is what I wrote in my email as a result of his explanation:

"After all these years, there is a possibility of a misunderstanding because in this class of court cases, there is no actual fully detailed verdict specified. The court limits itself to a short notice of the actual verdict. Only if a party decides to bring the case to an appellate judge, the full verdict is spelled out. This is the normal way of court efficiency. My case was a detail in the margin of the main case of the boys who actually had stolen the goods. Therefore the short note confirms breaking and entering, though at no time I was a party to such activities and to what the written classification says in the court record."

I explained some more but this basically says it all already. Because the case took place as a part of many cases as one, they basically wrote the main thing on the court records as the short note.

Yeah there is no problem there, I was told I could actually get the full detailed records but this might actually set me back for 3 to 4 months in waiting so I really hope that my detailed explanation and statement in email will help them to reach a positive decision.

As for the slight misunderstanding in the translation, I have ordered a new translation from a different translator last night as well. I have let this translator read both the original and the translation and he also think it might need some improvement to make things more clear. It should be ready the latest at the end of the week so I can hand them this translation as extra supporting evidence, of course I also said this in my email. It is going to cost me another 100 euro but basically I don't care about if it is going to be free or if it is going to cost thousands of euro's, as long as I can go to my sweetheart.

The complete email is about 2 pages long, I think I will call them somewhere this morning to make sure that I have send the email to the right address and to be sure that they actually received the email as well. Hopefully we will not end up in a bottomless pit where there is no telling of when and if we will get our approval (like what Sarah is going through.. I cannot imagine how it must be and I hope I will not have to find out about that).

Ok I just read on another forum that people got letters from NVC...does this happen? I thought besides the harcopy of NOA2 coming I have no other part really in this process....do I still get other stuff sent to me?! Thanks!

Steph, do not worry, we never got any mail from NVC even though they said we would have.. I guess it is the same with the paper NOA2, some get it, some dont :)

You don't really need it either,when you call the NVC you can give them your case number and they will inform you if they have the petition yet and, if they have it, what the status is :)

I'm doing ok I guess.. could be doing better... remember how you felt when you thought that you should get the NOA2 but didn't have it just yet? That's a bit how I feel.. I know a decision has to come soon but at the same time I don't know exactly when and I am scared that I might actually get into some timeframe of which nobody knows the end of :(

Michelle is doing better I think, she is more sober than I am at the moment and is like 'well, they said next week so it should be next week and they didn't say no or yes yet so everything is still open' (she also hardly checked Igor's list or checked the USCIS site, while I was checking it almost every hour lol).. I wish I could be a bit more like that though... it's all kinda scary to me atm.

Oh well, I tried to call them this morning (can only call between 8.30 and 12.00), I tried for 25 times but had no luck at all.. I will try again tomorrow morning but now as soon as they open, maybe I'll have more luck then. It is not that I want to tell them to hurry or want to inquire in my case but I do want to make sure that I used the email address of the right office and not that someone received it who doesn't know what to do with it.
