Potential Employer Refused NOA1

I'm at work right now. If anyone has their NOA1 could you possibly type in what it says in the body of the letter. I am really curious what they are reading and interpreting in this way.

My understanding is that this is only if we get an interview appointment that any status will be online. I tried explaining that an appointment in this type of case is rare and we can't access anything yet (and if we can I'm totally surprised because many threads here have stated otherwise!) If there is a way for me to check status now then I'll do it, although not for these bastards, for my own personal knowledge!!!

No, the appointment notice they're talking about is the biometrics appointment. Have you received that yet?

This is all it says. And refers to the letter that they already sent us - ie NOA1. They already have this information, although on the NOA1 it more detailed.

I'm not backing down from this though. Even if no job materializes they are going to learn the right way to do things even if it kills me!!!!!

I would make sure that your husband points out the document discrimination part and tell them you will take the matter further....

They should not be allowed to treat people that way.... in fact let me know which store it was at and I will drive to the Cape and come protest outside, invite the press and watch them back down big time......

Kathleen, does your husband have an unrestricted SSN? and a valid state ID/ driver license?

I recently saw the results of the Everify employers run (a staffing agency I recently went to were really nice and showed me everything). If your husband can provide the SSN and DL, then all the employer has to do is run his Everify, and it will say if he's eligeble or not, and when his status expires. The Everify includes a photo too, so they can confirm his identity.

Someone please correct me if I'm wrong. Hope this helps :)

Yes he has a state issued valid drivers license and an unrestricted SS card. They have all of that. They just don't know what they are doing. But they are going to get educated because I will not back down.

My husband is going to call today and I have the pages from the I-9 packet about document discrimination. In reading that we felt that three of the four things mentioned applied to this situation. I am going to highlight them and give them a copy.

I'm hopeful that this will straighten them out once and for all. But if not Kezzie I will be more than happy to join you on the picket line!

My husband and I got married in May of 2005. He got his greencard that same year in October and began working. No problem. He now has two jobs, one at a warehouse and one at the local Best Buy store. Living on Cape Cod year round is tough in the off season because once Christmas is over business tanks and my husband, who usually will work 4-5 nights a week, is lucky to get one night a week. So another store in the mall, Sears, actually approached him and offered him a job in their electronics department. They pay commission and Best Buy doesn't so we thought that maybe this would be a good move. Especially as Best Buy cuts their staff down a couple of times a year and Sears seems to be more consistent with their staffing plans. (This was in December). So Gavin filled out all the online information and went to an interview. About a month or so later he got called for a second interview. At this interview they basically hired him and sent him for a pre-employment drug screening and physical. The next day he calls the human resources manager and she tells him that the papers he gave them showing he is allowed to work (he gave them a copy of his greencard and also a copy of NOA1 and even copy of biometrics) were not enough. Unless he has a "valid" greencard they won't hire him.

I am totally outraged right now. I don't think the NOA1 could state more clearly that it extends his right to work and travel for one year. Date of NOA1 is early November 2007. Does anyone have any ideas of what we can do? He just recently travelled outside the US and has his passport and all to show that he was let back in the country. (Not to mention he's physically here and he wouldn't be had they denied him!) IF they had another reason for not hiring him then whatever. But they actually told him the whole reason was that he can't prove that he can legally work in the US.

I almost want to contact a lawyer because he is being discriminated against. We have done everything appropriately and legally and this is what we get? It sucks.

Not to mention that based on our filing dates and going through VSC I still think we are looking at June or July before he gets his new card.

Any suggestions would be greatly appreciated. If this thread should be posted somewhere else, please tell me. I just didn't know where to go but here.

Right, we would not have to go through all this harassment if USCIS would do their job properly but they don't so... we will see more and more cases like this !!!!

It is sad... because I can understand this happening in my country of origin... but here in the USA??? Where they claim they have the best system of the world?? Sorry, I do not want to offend anyone, I love America... but this makes me have think about their claimed efficiency!

Yes they do. But they cannot legally do it, and it's up to the PR to stand up for his/her rights.

Evidently Gavin never went back to Social Security to get the unrestricted card. He still has the one he got when he very first got here. I don't know how much it changes the "document abuse" on the I-9 instructions because he has provided his permanent resident card, which is expired, but he gave them the NOA1 extending it for a year. I still think they are breaking the law. Especially whereas they questioned the authenticity of the document saying "it is just a piece of paper so it could be from anywhere".

I called back today and got the same woman with the same story and I asked for her supervisor and she finally gave me the name of someone who is conveniently out of the office until Monday.

So now I have to find out from SS office if he can get an unrestricted card or some kind of a printout or something.

I really want to cry - I'm so frustrated.

Good luck to you and hang in there. We're here to listen to you if you need to vent. You are fighting a good fight. You are not only fighting for your husband, but for the next person that would get denied because of their ignorance, you are fighting for all of us on this board who believe people need to be educated about our rights as LEGAL PR's. So, I applaud you for trying to teach these people the error of their ways.

PS, I haven't got an unrestricted SS card either. I didn't know I was supposed to since I already had the card and a job. :wacko: so don't hold that too much against your hubby.

He shouldn't be screwed since we have filed I-751 and have the NOA1 showing receipt and extending his eligibility for a year. I could understand if that year was going to be up in 60 days or something. But the year won't be up until November 7, 2008.

Anyway now I have to find out if he can even get anything new from social security while this is pending (I-751 pending not stupid Sears #######)

Their most recent argument is that Gavin applied for a "permanent part time position" but he can't "permanently" work here. I said I could come in today and apply for the same thing and there is no guarantee that I would be working there "permanently". I could quit or they could terminate me. That is basic employment law. All employment without a definite contract is considered "at will".

I don't blame Gavin for not going back to social security. We've done everything legally and the right way and we know we are in the right. I'm not going to back down even if it does bring me to tears at moments. No one should have to go through this type of abuse. This lady is on a power trip and can't admit that she mishandled anything. Well that is going to be their downfall. Everytime I talk to her she is giving me more fuel for the fire.

I will keep everyone posted.

I made Tom go and get an unrestricted Social Security Card before his two year PR card expired. He went like 20 days before and they were trying to tell him some BS that he had to go 20 WORKING days before. Something like that, maybe it was 10. I don't remember exactly but they eventually gave in. What I took from that and from others on here, was that you can't get the unrestricted SS once your physical PR card expires. Which makes no sense since the status doesn't expire just the card. But you know how these government agencies are.

I personally already boycott Sears, they stink. Keep fighting it though. Did you go online and get a print out of what it says for his specific application? It sounded like that would have helped?
