Hi,

I found similar questions but not really what I am looking for.

My husband arrived on a K1 in October and as many he did not get his SSN within the first three month. We applied for the AOS at the begining of January (we got married in December 07) and he already had his biometrics done. Short after, we received a letter for the date of our interview, which will be at the end of March. Now - that I also would like to file taxes, I am waiting for the EAD to get a SSN. Is it normal, that we already received the date for the interview, but no EAD? How long does it usually take to getthe EAD after haven the biometrics taken.

As far as I understood - he cannot get a SS without EAD, since the I-94 in his passport has expired - right? Should I wait for the EAD or should I get a the ITIN (but he did not work) ?

You could get the ITIN to fill out your taxes if you're wanting to do this right away. EAD's usually get approved in about 3-4 months. If you've already got your interview for AOS, if approved, he's going to get a green card, and then the EAD process will be null and void by then. In ideal circumstances, he'll get a GC about 3 weeks after his interview if he's approved and then he'll just take that to the SSN office and get his SSN number. Ask at the inteview if he's approved if he can get an I-551 in his passport. This is a stamp that SOME offices give until the GC arrives, but basically telling anyone looking at his passport, that he's been approved, and he could just take that to the SSN office as well.

I just called ITIN and it seems that he cannot get this number because its for people who are not eligible for a SSN.

I think we probably just have to wait and if I don't get anything until the interview, I have to try to get the I-551 stamp as the final day of the tax return is the 17th of April (interview is 03/31).

Currently he IS not eligible to get SSN or the SSA would issue you one, in your case since SSA will not issue one you can get an ITIN from the IRS.
