Hi everyone,

I am a new LPR , married to an U.S.C. I want to petition for my son of 21 y.o (will be 22 y.o on march/02) and currently he is in the U.S on a F1 visa attending college in Pasadena (California. I am preparing all documents required , I would appreciate if someone having the same experience of petitioning a son or daughter and confirming if the following is correct :

documents required :

- form I-130

- Copy of my green card

- Copy of my son's birth certificate

- fee 355 $

Yes that is the list.

However if your son marries this will invalidate the visa petition, it is for un-married sons and daughters.

US Citizens can petition for married sons and daughters.

Yes your list is correct.... I too have filed for my over 21 son.... sad to say it will be many years before a visa becomes available for him..... Visas are available now for people who filed in 1999 so my son will have to wait 8 years....

Hi everyone.

I was under the impression that a Permanent Resident could only file for an unmarried child UNDER 21 and would need to become a USC before filing for their child.

Is this true that PR can file for OVER 21 unmarried child?
