im confused im in the process of completing my i864 can somebody help me with this my lawyer email me about this information can somebody explain to me and where can i get help thanks!!

Please provide us with the information and documents listed below so we may complete your Affidavit of Support. Once we receive the required information, we will complete Form I-864 and email the completed form to you for your signature.

1. Did you file US federal tax returns (Form 1040 or Form 2555, Foreign Earned Income) for each of the three most recent tax years? Please note that you do not need to file a tax return if your total taxable income is less than $8750. If this is the case, please provide us with a letter or statement from you stating that

a. You did not file federal tax returns for years 2006, 2005 and 2004.

b. The taxable income amount for 2006, 2005 and 2004.

* Please note that this information can be found on your Statement from the Social Security Administration.

2. Please provide us with a copy of your Statement from the Social Security Administration, evidencing the total taxable income for each of the three most recent years.

Form DS-230 is completed and we have received all the necessary supporting documents from "wife's name". We will send her the completed form for her review once we receive all of the required information to complete your Form I-864.

Also, since you make under the minimum wage requirement, we understand that cosponsor name will be the co-sponsor. Attached below are questions and a list of necessary supporting documentation for "cosponsor".

1. What are the total incomes as reported on your Federal tax returns for 2006 and 2005?

2. Please provide your Federal Income Tax Return (Form 1040) for year 2007 and if available, Federal Income tax Returns with W-2s for years 2006 and 2005.

3. Please also provide a new letter from your employer, Mr. and Mrs. Hoggatt. In addition to the information on their letter dated February 25, 2008, the letter needs to be on employer's letterhead, which can simply be their name and contact info typed at the top of the letter, and stating number of hours work per week and rate of pay.

Every year or so SSA sends to every US tax payer a statement showing contributuin to the system.

It is better to get and provide simple IRS transcripts for past 3 filing years.

Did your spouse not work and/OR file IRS returns over the past 3 years? I called IRS to get transcripts, and had no problems getting them.

My husband did not file tax returns the last 3 years either because he was a full time student. We just wrote a note on the I-864 saying that he made less than the minimum required amount because he was a student and enclosed the record from the university proving it. We didn't have any problems (we obvously had a co-sponsor)
