...if my greencard isn't approved by the time I move back to Germany? For the ones who didn't read my otherpost about this: My husband (USC) is in the military and will get stationed in Germany in June.

So what happens, if I don't have my greencard until then? I was told by an IO that it is pending at CSC eventhough I have an online update that it got forwarded to a local office. So right now I am not even sure, who has my application and wherever it is, I am wayyy out of any processing times.

I have AP right now but it expires in August. Can I just apply for a new one? Can I do that from Germany?

Would it make sense to abandon my I-485 and do direct consular filing before we move back to the US in two years?

Can they invite me for an interview if I am already in Germany? And last but not least...can I have letters from USCIS send to an APO adress????

Geez, I feel like I will be so screwed with this all....

Thanks in advance for all advice, input and thoughts. I really need some good ideas and advice, with the move, trying to sell our house in a short time, being pregnant on top of all, really stresses me out a lot and this is just something that shouldn't even be an issue anymore by now. So frusterating....

Sorry for the vent...I know it doesn't really help any....

You can apply for a new AP, but you cannot do that out of country.

Also you and your spouse will have to return to the USA to interview at the field office that has your case.

Abandoning the case and starting over in 2 years is an option, however consider this, you will loose those that time counting toward residency requirement for filing for citizenship. Green-card holder can live out of country is living with US citizen that is station overseas in the military and the time is considered to be resident.

On a plus note, if you do abandon, and then later DCF, the green-card you will get will be a 10 year un-conditional card.

This all is just BS! I should have my greencard for a while now. :o

Right now I am just hoping and praying for a miracle and that my application is still in California and they approve me without an interview before June.

I can still hope, right?

Nane, I assume you already had your biometrics appointment and just waiting on the initial interview? As a military member, you husband can apply for an expedited appointement using the Military move as the justification. I recommend you make an appointment at the local USCIS office via the InfoPass appointments and go talk to an Immigrations officer. Granted they do not always know the right answers either, but they can tell you where your case is "in the system".

Your husband will need to provide a copy of his assignment RIP and a written statement from his commanding officer to send with the expedite request. If you appointmen has already been applied for, your interview should be way before June anway. Good luck, Ken & Maria

Nane, my wife and I have been through this already. Apply for the expedited interview appointment first or apply for the expedited interview and AP extension at the same time. There are exceptions for the Military due to the frequent moves required. Ken

I spoke to an Immigration Officer via the customer service line. The guy there told me, that my case is under review at California Service Center and I have to wait with getting things expedited until the review is over. It's under review because about 6 weeks ago, before we knew about the move, I contacted the Congressman here. USCIS waited 4 weeks until they actually put the review into the system :wacko:

So I don't have to wait for the official orders to come, the RIP is fine too? What kind of statement do I need from his commanding officer? That we are really going?

Also, my husband has to go to a 4 week training before he leaves, which will cut out even more time. What if they schedule my interview while he is in training? Should his commander put those dates into his statement, so they don't schedule the interview for this date?

Gosh, this is so nuts!! THanks very much for all the adive and help, I appreciate it very very much!!!!

I had a touch today...at least someone is doing something...lol 1st touch since Oktober 2007

I also talked to the congressmans office today. The lady who put in the request to inquire on my case tol me, she will send an email or letter to USCIS to update them about my situation. If they haven't gotten the memo from the IO I have talked to last week, I hope, they will get that one.
