just called USCIS about my case.. went through the "approved" line, supposedly it was approved.. then I say my case was different from others (he agreed), and I asked which one would get approved... the interview guy said he can "directly forward my case to the consulate".. I asked the USCIS person and he said this : "I-129F (or K3 visa) will be forwarded directly to the consulate, while the I-130 will have to be sent to the NVC".. he said it seems I can skip over the NVC if the interview guy had approved my K3.. otherwise I would have to wait a couple of months before it will reach the consulate in China.. he also told me to call back after 60 days if I didn't get anything..

I-130 STAGE 1 : 533 days - 1 year 6 months (4/16/2007 to 9/22/2008)

Priority Date I-130 : 4/16/2007 ( 533 days , APPROVED 9/22/2008)
Transferred to local office based on "security checks" : 11/27/2007
wrote hundreds of letters - received letter from FBI Records Management Chief stating no security checks
local office interview : 2/21/2008 - brought my parents too (result : you will get approval within 2-3 weeks)
5/2/2008 - (lawsuit) Writ of Mandamus - OFFICIAL DATE (7/29/2008)
9/22/2008 - CALL AND EMAIL COPY OF APPROVAL NOTICE FROM LAWYER

NVC STAGE 2 : 99 days - 3 months (9/30/2008 to 1/7/2009)
NVC Received : 9/30/2008
Received Packet 3 (I-864/DS-230) : 11/10/2008
NVC says "RFE sent out 12/9/08 for missing documents" : 12/10/2008
CASE COMPLETE - 1/7/2009

CONSULATE STAGE 3 : 96 days - 3 months (1/8/2009 to 4/14/2009)
CLEARED CUSTOMS - 3/10/2009

still not sure yet, when the NOA2 notice arrives in the mail.. that's when I will know.. I made a local office appointment on March 7 (infopass), just in case... but hopefully it will be here before then.. to tell you the truth, I don't know even if I am approved or not.. I'm not celebrating round 1 victory until I get that paper in hand.. then the round 2 battle will be the consulate battle.. I have seen some things I need to prepare (not just packet 3 or packet 4).. a "letter of evolution relationship" and also "all tickets / trips I made to China".. but that is just for people who are in China =)

My lawyer told me that k3's bypass NVC and go straight to the consulate.

Well I don't know if I believe this or not, because she hasn't really been very on top of things with us.

BUT....lets hope that this is true, because this means that we could be with our loved one sooner.

haha, I'm still confused.. if that is the case, then why are we waiting at the NVC in the first place? Can't they just "forward" our I-129F (since they are linked anyway now) to our consulates?.. or maybe this 4 months for Guangzhou Consulate is the "forwarding and receiving" part?...something is wrong in this situation.. well, the whole thing is wrong, but I'm at this certain part now.. :lol:

that's something we have to do for China.. they are real picky.. it basically 1-2 pages of how you two met , and give a timeframe of everything after that.. paragraph form (like a story, not just a timeline).. I wrote one in English already, and she wrote one in Chinese / English.. the interviewers may not be Chinese after all.. I just found the stuff on Candleforlove (mainly for China Guangzhou consulate).. also something about a picture of you in front of a post office holding a local newspaper.. where the date of newspaper and post office address are visible.. now this rule is stupid, haha.. but I still want to do it.. I see a lot of people getting blue slips (pass/fail - pink is pass, blue is need more evidence, white is fail).. normally they will give out blue slips before they give out a nasty white... you get about 2 or 3 chances, so that's good.. but I hear you have to repay the consulate fee, which is not good =(

well, anyway, take a look at some interviews that happened in your consulate.. and just try to do everything.. just like my local office interview.. I had prepared for everything, but it was a quick 2 minute interview (mainly because my parents were there too, everyone dressed up).. it's better to be more than prepared than not..
