how long to keep it active

My wife and I have recieved the NOA2 approval on the 12th Feb. WE are struggling still to find a sponsor and are thinking that we may need to delay the process and look at going back in 10-12 months. Does anyone know how long they will keep our case active. How long can we wait before sending the next lot of information that they require?

My wife is dealing with some chronic health issues right now and moving back at this time isnt a great option. Is there an option to extend our case?

We talked to a USCIS officer in fFrankfurt a while back and she said that there is an option to extend the validity of an approved I-130, although I do not know exactly how it is done. You might have to ask them directly.

As far as I know it is not possible to extend the visa without major difficulties. But in your case you won't apply for the visa yet anyway, right? Even if you did and they set an interview date, you may be able to prostpone that appointment as well. After all, you wont get the visa without a sponsor.

I don't think I would openly tell anybody at USCIS or the department of state about your sponsorhip problems. Just use your wife's medical condition as a reason - they are way more likely to symapthise with you then and will probably help wherever they can.

Unless something has changed recently, an approved I-130 petition is normally valid for one year from the approval date. I would send a letter explaining the situation to the same address you've been given for sending the DS-230. Be sure to include your full details and case number on the letter. I'm sorry to hear that things aren't going as well as planned.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
