Hard question - Student Visa, married, etc

Hi,

basically this is my situation.

I've got a US girlfriend, and we plan to marry later in October 2008 here in Italy, where we live and after she graduates from university.

At that time, I will be working on my application for admission to a MBA program in the USA... My question is: what shoudl I do about the visa? Should I normally go for my F-1 student visa and then apply for adjustment of status or what? How does it work?

Thanks a lot for your help!

Roberto

I know nothing about this, but I think that if you are marrying a US citizen, you should be looking to enter a country under a spouse visa, so that there is no suspicion of fraud.

Rob,

You can apply for a student visa and then pay international student rates. Or, you can apply for a spousal visa (CR1), establish residence here in the US and then pursue further studies (and pay resident rates).

Why not just apply for a CR1 after you get married, rather than a student visa?

Check to see if DCF is available to you in Italy.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

PLEASE DO NOT PRIVATE MESSAGE ME OR EMAIL ME. I HAVE NO IDEA ABOUT CURRENT US IMMIGRATION PROCEDURES!!!!!

I couldalso defer admission by one year, that wouldn't be a problem. The fact is: my wife is a student and she won't start woking full-time before October 2008 let's say. if we file for a k-3 visa... (after married)... will her paycheck be enough to demostrate that she has enough funds to support me (based on the fact that if she earns a set amount each month she will earn that amount for a longer period)? Unfortunately she doesn't have any cosigner, as her family wouldn't support us in this... :(

Another thing is: can she use her bank account to demonstrate she has enough money? if we open a joint bank account in the USA, and I put let's say 20000 EUR in it, will that suffice?

Thanks a lot in advance!

Your circumstances sound very familiar. Didn't your fiancee ask these questions a while back?
