Help with I-130

Timeline

I am about send in a I-130 application for my wife. I have some questions someone may be able to help me with.

1) My wife has a 13 year old daughter, do I need to file a SEPERATE I-130 for the daughter?

2) If I need to file the I-130 for the daughter, does it go with my wife's I-130?

3) If I do NOT need a seperate I-130 for the daughter, do I need to include the daughter's G-325 with my wife's I-130 or do I wait until I send the

I-129?

4) On the I-130 form, Section D, Question 1, do I put the dughter's name here, even if I am not sending an I -130 for the daughter?

5) If I have to file a sperate 1-130 for the daughter, does it require an additional $355 fee?

Thanks for any help any of you may be able to give me.

I have been filling out forms, reading government websites and getting certified documents every spare minute of every day for weeks. And I know this is only the beginning!

June 2007.................Met On-line

August 2007..............Travel to China

January 31, 2008.......Return to China

February 1, 2008.......Marriage Registered in Urumqi

February 4, 2008.......Ceremony and dinner at Hotel

March 6, 2008...........I-130 sent to Chicago Lockbox

March 7, 2008...........Received at Chicago

March 12, 2008.........NOA1 on I-130

March 18, 2008.........I-129F sent by overnight USPS

March 20, 2008.........Received at CSC (so much for overnight!)

March 21, 2008.........NOA1 on I-129f

March 25, 2008.........Both cases Touched

May 9, 2008..............I-130 and I-129F Approved!

May 12, 2008............Email notice that both petitions were approved!

May 17, 2008............NOA2's arrived by mail

May 19, 2008............NVC recieved

May 21, 2008............Leave NVC for GUZ

May 26, 2008............Arrive GUZ, waiting at Customs

July 2, 2008..............Papers FINALLY our of "CLEARANCE DELAY"

July 3, 2008..............Out to DHL Facility (?)

July 3, 2008..............Consulate received

July 20, 2008.............P3 arrived

July 20, 2008.............P3 returned to Consulate

I am in a similiar situation as you in the sense that my soon-to-be husband and I are filing for myself and my 2 childeren. I wouldn't risk the K3 journey at this point and would instead petition for the IR-1/CR-1. The risk is that if they cancel your K3 in favour of the IR-1/CR-1 (which has happened for many), you will have to send the additional petition for your stepdaughter anyway, which could delay things.

1. Yes, you file a separate I-130 for your step-daughter if you go the IR-1/CR-1 route but not for the K3.

2. If you decide to go IR-1/CR-1 you can send the 2 petitions in the same package but they will be viewed as separate petitions, each requiring their own $355 cheque. If you go K3, no petition is sent for child.

3. You only need to send the G-325a for wife in both visa scenarios.

4. Not sure.

5. Yes will require 2 fees of $355, written as separate cheques. Only one fee is required for the K3 as it is one petition.

12th April 08 - Married in Australia

21st April 08 - Mailed off I-130 but with incorrect title on cheques

30th April 08 - USCIS returned petitions requesting correct title on cheques

2nd May 08 - Mailed out I-130s again! Finally on our way!!!

9th May 08 - NOA-1

7th Nov 08 - Tranferred to CSC

4th Dec 08 - Approved!!!

22nd Dec 08 - NVC # assigned

23rd June 09 - Case Complete at NVC (We slowed down the process on purpose to time interview accordingly)

18th August 09 - Medical

25th August 09 - Interview Date - Approved!!!

19th February 10 - POE L.A (No dramas, just SLOW)

2nd March 10 - Welcome to America Letter
