Getting married to a Permanent Resident

Hello guys,

I love VisaJourney, I think that it's fantastic that you help sooo many people..

Now I need some help.. I came to USA exactly 2 years ago, tomorrow.. I came as an Au Pair on a J-1 Visa. My visa is Not a subject to 2 year something, something.

After the first yaer, I applied for a tourist visa, and got it for 6 months. I also had one month extra on on my J-1 visa, so I was legally here untill Sept. 27. 2007.

I meet HIM :) two weeks after I came to the states, started dating, started living together almost one year ago. He proposed in Oct. 2007.. He is NOT a US Citizen, he got his welcome letter in June 2007. However, the actuall green card he was suppose to receive within 60 days, never came.. In Jan. 2008 he made an infopass and got a temporary one.

We wanted to get our parents and closest family here for the wedding, but with current problems in my beautiful country ( Serbia, the country that burned the US ambassy the other day ) , that is impossible, so we decided to get married soon. Can anyone help me out a bit.. I am not even sure that is possible.. Anyways, any help would be very much appriciated.. Sandra

Timeline

Once married your husband can file a I-130 for you but depending on your countries timeframe that could be years away from a visa number becoming available. The same forgiveness that is granted a US citizen are not the same for a permanent resident.

Once your husband becomes a citizen he will be able to upgrade his I-130 petition as a visa number will be immediately available.

Because of the overstay involved and the basis of the petition being from a PR, definitely consult a immgration attorney.

02-21-2008 Interview in Garden City:Approved

03-06-2008 Card production order

03-06-2008 I-130 Approval notice sent

03-06-2008 I-485 Notice mailed welcoming the new permanent resident

03-11-2008 I-130 Approval notice and welcome letter received

03-18-2008 I-485 Approval notice sent

03-20-2008 Received Green Card!!!

Removing conditions:

01-07-2010 I-751 packet sent

01-11-2010 11:00am packet delivered

01-25-2010 Biometric letter received dated for 02/11/2010

03-03-2010 Card production order

03-11-2010 Received Green Card!

Citizenship:

04-05-2013 application for naturalization received by uscis

05-06-2013 biometrics appointment

07-24-2013 citizenship test appointment - pass!! smile.png

08-07-2013 Oath ceremony - Naturalization approved smile.png
