02/15/2006: Began Canadian Immigration

09/19/2007: Withdrew CIC application (they still hadn't processed anything)

10/01/2007: Moved back to U.S.

10/29/2007: USPS confirmation of receipt of I-130

02/13/2008: NOA-1 received (107 days)

07/02/2008: I-130 approved

07/22/2008: AOS filed including EAD and AP

07/25/2008: NOA-1s for all 3 received

08/20/2008: Biometrics appointment

08/22/2008: Received RFE for Affadivit of Support and Medical

10/21/2008: Submitted I-865W in lieu of co-sponsor and medical info to NSC

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

04/21/2009: GC received

IR-1 = married 2 years + (results in a 10 year no conditions green card)

I was married on 3/16/2007...so if I am approved for the visa (interview and all) BEFORE 3/16/2009, I would be issued a CR-1. If I am approved AFTER 3/16/2009, I'll be issued an IR-1. Is that right?

The immigration lawyer we've spoken to (briefly) had mentioned that the silver lining in our visa procrastination is that by the time I get approved, I'll most likely have a 10 year green card. Also, what is meant by "no conditions" vs. "conditional"?

Simple questions, I know!

A permanent resident is given the privilege of living and working in the United States permanently. A person's permanent residence status will be conditional if it is based on a marriage that was less than two years old on the day they were given permanent residence. A person is also given conditional resident status on the day they are lawfully admitted to the United States on an immigrant visa (having been married less than two years and entering on a CR-1 Visa). A person's permanent resident status is conditional, because they must prove that they did not get married to evade the immigration laws of the United States.

Correct if your interview will take place after 03.16.08 your visa will be IR-1.

About conditional (CR)v. nonconditonal(IR) I'm not sure. I think to remove condition (2 years validity change for 10 years) you have to be still married. I might be wrong.

You mean, if my interview takes place after 3/16/09, right?

About the conditional vs. non-conditional, I understand, I think. All I know is that it would be nice to have everything timed to get the IR-1, as opposed to the CR-1 (although I'll be happy just to be with my hubs!!)...

lets say your interview is before 3/16/2009 but you enter the US with your visa after 3/16/2009, you need to tell the immigration officer that you have been married for over 2 years and show them your marriage certificate and you should get the 10 year card.....

Gotcha...thanks for everyone's insight. We have many hurdles to overcome before I can even think about CR-1 vs. IR-1! :blink:
