Timeline

After 2 years in relationship and up to first few days before my interview I have known that my fiance has filed for a fiancee visa before with a girl but it was only till NO1. I feel betrayed by him same time I am worrying if this is going to matter in our case. That was in year 2004 and he did not know about the case. He assumed it was cancelled already but I am worrying it is not cancelled unless it was noted at USCIS. Anyone here please help & guide me what to do. We have been fighting about this and I blamed him for making me feel a fool! :help: :help:

I'm sorry to hear that if CO asked about it make sure u know the whole story why their relationship not successful...because they will find out even if its was only NO1...

He told me it is assumed the petition was cancelled coz there's a time limit to respond to the petition and the girl did not like to continue with it. That happened few years back & he did not write an official letter to USCIS asking to close the case. What should we do? Does he need to inform USCIS about it or it happened automatic after no response was made to the case. I am really upset at him for hiding this from me until he has no choice but tell me about it coz it could be asked during my interview. Please help!

im sure they will ask it.... what I've hear he need to write an official letter to USCIS to cancell the petition.. or lets hear from the others opinion....

im no expert but here's my suggestion... ask your fiance the whole story and get familiar with it. knowing it was in 2004 it may have been forfieted on its own or it may have been not. who knows it may have been reach as far as NOA2 or more knowing nobody canceled it... but here's the thing, dont bring it up during the interview, and if and when they will ask you for it during the interview just tell them the truth (from your fiance's mouth) and that you know this already and you and your fiance have talked it out. i dont think its best to say that you just knew it now, right before the interview... as for why they didnt cancel the petition then, if ask, just say your fiance didnt know what to do or what the right process would be back then... i really hope things will work out. for now dont stress about the interview. focus on the relationship first. be open to everything whether it could hurt you or not and from there you'll weigh where you stand. i do believe you love each other and by hiding the truth from you may have been a good and valid reason on his part even if its wrong in your part but there isnt right or wrong for now. we'll just deal with here after and communicate so it wont happen again...

this is just my opinion and anybody can shoot me against it, just go ahead. lol... :blush:

my fiance (whose my hubby now) submitted a K3 visa application before with his former wife. When we met & decided to file K1 visa application, he didn't submit any formal letter of cancellation of the previous application. Since, like what your fiance said, there's a specific time alloted to response on any USCIS paper's development. Although my hubby decided to send a formal letter of cancellation (attached with copy of divorce of paper) to USCIS when we received our NOA1. It was the advice my hubby received when he called the USCIS regarding this matter.

Well, in your case "maybe" your fiance needs to formalize the cancellation of previous application ..even it was submitted last 2004..

and he might want to mention in the letter that he's not wishing of any effect of such application to the current one. anyway its not that expensive to send a letter..if in case USCIS find it useless, they can throw the letter freely.. At least, in the end your fiance got to formalize everything.

this is how i see things ..in connection with our previous experience..

lastly, like what others said ..you should be aware of the whole story ..so if in any instance it will be brought up in your interview, you know how to answer those questions (confidently)...

Don't hold that against him and no reason for fight..Past is passed..it happens because you and him are belong to each other arms..like others said here,no need to mention if they did not ask during your interview..i think it will be cancel if no respond for that long for the petition..its been 4 years..don't stress urself too much..this is not time to fight or blame him,time to support and show how much you love each other..goodluck!! :thumbs:

Since Alexandra8886 have been in the same situation, take her advice. I can understand your anger, but past is past and what matters now is you and him and your incoming interview. No need to quarrel, this is the time that you need each other's support so you two can work things out. Edited by jom

I can understand your anger, but past is past and what matters now is you and him and your incoming interview. No need to quarrel, this is the time that you need each other's support so you two can work things out.

right :thumbs: don't dwell too much on things that happened in the past. Giving so much attention into something that has nothing to do with your current relationship is just stressful.. I know you feel offended of hiding such incident for a while but don't let this stuff ruin your current relationship with him & the wonderful moments in the near future. :blush:
