hello to everyone! we are just getting our AOS paperwork together to hopefully send out this week. We were just married Feb 16th!!!! anyway, I am the petitioner (the USC) and I have changed my name to his legally this week. I am assuming that I fill out my portion of the AOS forms with my new married name since that is my legal name?? probably stupid question, but just wanted to be sure since I petitioned for his K-1 with my maiden name.

thanks in advance for replies! I will no doubt have many more questions as we begin this next step!!! I appreciate any and all help! this forum is great!!! (and yes, I search the guides regularly!!!! just need some reassurance from time to time!)

Yes you would fill out the forms using your married name.... where it asks for "other names used" you would put your maiden name...

It is the US Citizen changing name, form I-485 only asks for Spouse name. US citizen does not provide form G-325A, only I-864(EZ) and I-864 also does not ask for other name used.

If it were prospective immigrant, then yes, on form G-325A there is a line for other names used, and on form I-485 maiden name goes on line that says name on I-94 card, and married name is in Part 1 of form I-485

I understand that the AOS paperwork will reflect my wife's new last name but does this apply for her children also? I finished all of the AOS paperwork using her new last name for the children but now wonder if this will be a problem with USCIS, since I have not legally adopted them. Maybe I am over thinking this issue but I am trying to avoid an RFE if possible. Thanks for any info.

At the moment that you got married you have the new name legally I think, because you can show it with your marriage certificate.
