Hi!

NEED HELP!

My fiance and i applied for the K1 visa last year (jan. 2005). Everything went fine, we got the NOA2 etc very fast. but unfortunately due to strong personal problems we had to cancel the visa a month before the interview. =( (i kow it was terribly stupid, but there was no other way)

after the problems were solved, we applied again in september 2005! we got a new code etc -

but now we re waiting since then with no message, no NOAs no nothing =(

It is already 7 months! without any new information and it is driving us nutz...we called the uscis, the embassy . but all they are saying is that it is under review =(

has anyone experienced a similar situation? has anyone had to wait that long? does anyone know what would be the best thing to do (write a letter?, layer?)

any information would help---we d be very greatful

Aug. 1999: met and fell in love

Aug. 2000: engagement

Jan. 2005: filed for K1

March 2005: NOA 2/ August Interview

May 2005: had to cancel K1 =(

Sept. 2005: filed (again) for K1

Okt. 2005: NOA1

Nov. 2005: touched

May 2006: contacted house of representatives- for help

19.May 2006: received letter from member of congress that they have found out that our case has been denied due to outdated proof. We never received any info from the service centre itself; they did never ask us for any new additional proof or information

19/20/21..Mai 2006: LOADS of worries!!!

22.May: first contact with immigration lawyer

30.May: email from USCIS: petition approved March,11,2005- petition referred to National Visa Centre for processing- Petition referred to Consulate- Department of State did not issue a visa!

June 2006: applied again for K1 with the help of congressman

Sept 2006: contacted senator...no further help

Febr 2007: still no info---nothinggggggggggggggggggggggggggggggggggggggggggggg

Have you contacted them? You should be doing that.

Also, your withdrawal and doing it again now might raise a red flag for you, but for now, check with them to see why it´s taking so long to either get an approval, denial, an RFE, or anything at all.

You are most definitely outside of the normal processing time. I would try to contact my local representative to see if they can help you find out more detailed information about your case.

My NOA1 date is November, and i still havent gotten an NOA2, i contact my congressman, and today i was touched, dunno if anything is happening, but DEFFINATLY contact someone high up. They are so friendly and helpful and actually care.

Have to agree with the others - contact your congressman's office and ask if their Immigration Liaison official can find out the status of your case.

Our journey started in 2001 and it's still not over. It's been a rollercoaster ride all the way! Let me off - I wanna be sick!

i guess we havent called the right numbers yet...as we did call the texas centre (local representatives?)

and they couldnt give any info.

I am in somewhat of the same situation you are, and I am hoping and praying that is not what is holding up my NOA2. I applied the first time back in 2002, and due to the fact we were not quite ready for everything we cancelled ours also, but we didn't stop loving each other and we always knew we would want to be back together one day when we were both ready. We kept in touch over the years, he visited me, and now that we are both more mature and know exactly what we want we feel we are in a much better position to get married and have a fulfilling life together. So, we decided to apply again, this year. I contacted an attorney and spoke with him about it and he said there is no problem with doing this and it should not be a problem or raise any red flags as we did not break any laws. I wrote CSC an email yesterday about our case because I am starting to get worried about not getting our NOA2 when a lot of others that have applied after me are getting theirs, and this was their reply:

The petition is undergoing security checks required of all applications and petitions, there is no time limit to this processing. Please 60 days before your next inquiry unless you receive a request for evidence or a approval notice.

So, I am hoping and praying that this part of the process just has not ended yet and the NOA2 will be on the way soon. Have you contacted them by email? If you have, what response were you given? Were you given the same one I was? Was your case transferred to CSC or is it really at the TSC office? Mine was transferred over to the CSC office. Well, I hope we both get our NOA2 soon, we both deserve it, just because we did the right thing by cancelling our petitions prior to finishing because we weren't ready, isn't any reason to punish us by making us wait forever now. Please keep me informed on how your case is going.

My hubby and me had the a similar situation last year too, we applied, got the visa, I came to USA and I had to leave before the 90th day for personal reasons.

After few month we re-applied for a K1 visa and like you our petition was under AR for a really long time we didn't know what to do but after waiting and waiting we contacted our congress man and after two weeks we had our NOA2 ...we aren't really sure if he had to do something with that but somehow it worked!

So contact you Congress person, it won't hurt. Good Luck :thumbs:
