Hello everyone,

I'm a US citizen who has been working in Japan for about 6 years now. I recently received a job offer to work in the US beginning in early May, 2008. Once the offer came in, my Japanese wife and I began gathering all the documents to submit the petition for a spouse visa. We will submit our I-130 petition and supplementary materials here in Tokyo on March 4.

Everything is in order accept one additional document for the I-864, Affidavit of Support. Unfortunately I was unaware that I had to file my US federal income taxes. It was an honest mistake. And luckily I don't owe any money. When we decided to start the whole spousal visa process earlier this month (February), I realized I did indeed have to file; therefore, I immediately filed my taxes for the last 3 years.

It stipulates in the I-864 instructions that the petitioner has to submit a tax transcript if returns in the last three years were filed late. I will be attaching copies of my 3 most recent returns to the I-864 along with an explanation explaining that I cannot furnish a copy of my federal income tax transcripts because of the 4 to 6 weeks tax return processing time at the IRS and our tight time line for moving back to the US.

My question: Does anyone have any experience with how lenient embassies are with regards to the tax transcripts under tight time lines? If so, could you let me know?

File returns late, and then attach copy of return to the I-864, transcripts not needed when you attach copies of returns.

Another requirement of the I-864 is US Domicile.

Is now a US Citizen immigration completed Jan 12, 2012.

Hello,

I just finished the visa process for my wife at the Embassy in Tokyo and from our experience it was very lenient. I too had to file one of my tax years late, but fortunately my transcripts were adjusted on time. Everyone we talked to at the Embassy was very understanding and helpful. They even made some corrections on my I-864 when we submitted the I-130. I'm sure with copies of your tax returns and a written explination would be fine.

On another note, the whole visa process took only about 2 months. It would of taken only 1 1/2 months if we applied for the final interview earlier. Applying for a spousal visa at the US Embassy in Tokyo is definately the way to go. Good luck.

Hi Kinshi,

I know this is off-topic from the original poster's question (although most likely of interest to the original poster), but since you applied in Tokyo, maybe you can help me. I am about to file the I-130 for my wife in Tokyo, but we have questions concerning the translation of documents. Did you translate your Japanese documents from Japanese to English yourselves? Or, were you required to get someone else or even a professional translator? Also, were you required to have the translations notarized?

What if someone has filed tax returns for 2009 yet.Would 2008 tax returns be acceptable?Since it clearly says 'most recent' not last year's.
