I need a little help.

Here is my case.

I am waiting for a K1 visa for my Girl

My good job in Gaffney SC went to hell on me and I am looking for new work

The only good job I can find is in Canada

So what do I do.

I can go to Canada. But I am worried about her.

My parents live in Seattle and have offered to let us use there address.

I just don’t know what to do. And I want to bring her to Canada with me.

Tim

A few complexities, K-1 is for entry to the USA and marriage in the USA, it is not for moving to another foreign country like Canada. If she moves to Canada shortly after entry to the USA on the K-1, she wont be able to re-enter the USA. Also she would need a visa to enter Canada.

If she remained in the USA after marriage adjusted status, and got green-card before entry to Canada, she will be considered a visitor of Canada, and will have to return to USA and not overstay visit to Canada. Green-card holders are allowed to visit Canada without a visa.

Lastly a green-card moving to another country to live permanently will be abandoning the green-card.

From my experience, the job market in the Carolinas is quite good, why can you only find a job in another foreign country?

Hello YuAndDan,

Is your above statement correct? For instance, my Thai wife is now a GC holder (2 year conditional) via the K1->AOS process.

However, Thai people need a visa to enter Canada, because Thailand does not participate in Canada's VWP.

Therefore, my understanding is that my wife cannot enter Canada with her Thai passport, even though she does have a US Greencard. She won't be able to enter Canada until she had a Canadian Visa. I suspect that the case would be the same for same for the OP, considering that she is from the Philippines.

Please let me know if I'm incorrect (which is HIGHLY possible!).

Peace to you!

Yes it is correct, My wife has CR-Green card, Chinese nationals are required to have Visa to visit canada, however I-551 Green card holders are not required to have visa.

Visitor Visa Exemptions

persons lawfully admitted to the United States for permanent residence who are in possession of their alien registration card (Green card) or can provide other evidence of permanent residence;

Same applies to Mexico, and neighboring islands in the Caribbean, oh yes and also Switzerland.

Thanks for the help

does anyone know how long it takes to get a visa for canada?

Visitors visas are fairly quick to get, immigrations visas like the USA can take time.

Visitors data: http://www.cic.gc.ca/english/information/t...mp-visitors.asp (Look at Manila)

Immigrants to Canada: Like USA require Canadian Citizen or Employer sponsorship. http://www.cic.gc.ca/english/information/t...l/menu-perm.asp

NOTE: A K-1 holder needs AP in hand from filing I-131 with the I-485 to adjust status before leaving the USA while waiting for a green-card from adjustment of status.
