I am just wondering is it possible to file my AOS without I-94 because I want to file my AOS before my 90 days of entry. I didn't receive my I-94 when I entered USA from Vancouver, Canada so I had filed I-102 and paid $320 for it but on the NOA of I-102 it say that they need 60-180 days to process. That means I probably will get my I-94 number after the 90 days. Should I just send in a copy of the NOA of I-102 when I file AOS or I should wait till I receive my I-94#? Unless there's a period of time after I get married that I need to apply AOS.

Also do I have to have SSN before applying EAD because I am thinking of applying SSN after AOS.

to my understanding , there is realy no timelimite to when you have to file AOS , as long you you can prove you got married within 90 days of entry with K1 ( if you are K1 , sorry dont know what a I 102 is , but with k1 I know they issue a I 94 when they process the K1 and stable it inside the passport )

as to the SS# you can aply 2 weeks after entry or after the marriage thats up to you , its not needed to apply for AOS, EAD or AP good luck

Thank You. I-102 is application for replacement/initial form I-94 since I didn't receive it at POE so I had to apply to get one.

I did some reading and yup , you dont have to aply AOS within 90 days of entry , all you have to do is get married within 90 days , the AOS you can waite to get the I94 , or maybe send a copy of your NOA I 102 , but am not sure if they will accept that ( someone might know more about that and correct me )

My wife came in from Montreal and she did not get an I94. Canadian citizens do not necessarily get I94's when they enter the US because it is a continuous land border (and hell, its Canada). In fact, she never got an I94 during any trip to see me.

Before filing AOS, I asked a few people here who had the same situation, and they said it is not a big deal. We filed without an I94 and have encountered no problems to this date (Even our interview officer did not ask where it was). I believe it is known at USCIS that Canadians do not always recieve them at the border.

If you want, do what we did. Whenever there was a question on any of the applications about I94 # or I94 expiration, etc. we wrote "see attachment" and then on a serperate sheet of paper typed the question #, my wife's name, and her explanation that she did not get an I94 because she is Canadian. She swore that what she wrote was true and attached a copy of her bus ticket and passport.

I am not the first to do this, and like I said, so far so good.
