Re-applying for I-129F

We applied in September 06 and were approved June 07; however, due to personal and financial issues at the time, my fiance could not follow through. We broke up for six months and he let the I-129F expire.

New years day of 08 he called me and proposed - he was finally ready to take the plunge (I had really been pushing him before and finally just gave up and we split). I visited him in February 08 and we called USCIS. One person told him there is no record of us in the system, and to re-apply. Another told him he can either meet at a consulate office for a meeting, or he can re-apply.

We put together another package. On the first page of the I-129F there is a question about if he has applied for this before, for who, the A#, result, etc. So as soon as he tracks down my old A# he can send the package away. He attached a seperate sheet explaining why he let the application expire, and that he wanted to apply for a waiver to re-apply (as per the USCIS website instructions).

Anyone have similar experiences? I guess what worries me is that applying is a serious thing, and he was just not ready at the time. I don't know how USCIS is going to see it?

Filing fees have gone from $170 to $455. OUCH!

He will need to request a waiver in writing along with the new petition. Explain the circumstances,with any evidence he has to back up his statement. It would help if he includes a copy of your previous NOA-1 and 2 as well as provide the A # .

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

It sounds like he is doing everything correctly. :thumbs:
