My fiance and I are going househunting when I arrive there at the end of the month. My question is this: Can my name go on the mortgage application if we're not married? I mean could I declare the income I have from the UK?

Or can he just add my name to the mortgage after we are married?

I'm trying to make sense of this so that when we do come to AOS, it wont be messy!

5th February 2008 - I-129F forms sent for K1 visa (VSC)

26th March 2008 - NOA2 recieved via email

19th May 2008 - Interview............APPROVED!!!!!!

21st May 2008 - Visa in hand

29th July 2008 - POE

2nd September 2008 - Married

19th September - Mailed AOS/EAD/AP to Chicago lockbox

25th September - Check cashed $1010.00 (OUCH!!)

29th September - Received NOA's for AOS/EAD/AP

13th October - AOS Petition transferred to CSC!!!

17th October - Biometrics (Tampa Office)

17th October - AOS/EAD Touched

20th October - AOS Touched

21st October - AOS Touched

6th November - AOS/EAD/AP Touched (probably due to change of address)

10th December - EAD approved

28th January 2009 - GC approved without interview. Done with all this till 2011!!!!!!!!

Whenever I do anything credit related, they need an SSN. This may be a hurdle to getting your name on the mortgage.

married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

In addition to previous responses, real estate and contract laws will differ slightly from state to state.... So any general answer you receive here may not be your experience

Hi,

I doubt the mortgage company will finance a foreigner.

Is ist necessary to finance together?

Your fiance can buy the house in his name only, finance it alone and then after the marriage put you on the title (there are some restriction about the amount you can gift to your alien spouse per year!). We did not have a problem filing AOS and the name was in my husband's name only. I live in Florida.

We have done quite a bit of research on this issue and talked to our real estate agent about it. As long as your status is not adjusted, you will most probably not be able to have your name either on the deed nor on the mortgage. This may vary from state to state. As soon as your status is adjusted you can add your name to the deed and to the mortgage. Good luck with the house hunt!!! :thumbs:
