Hi all,

Hope someone can answer my question. I am a US Citizen and was just wondering if I can file form I-130 for my biological parents to immigrate to the US. I immigrated to the US as my aunt's adopted son (not legally adopted). My parents were very poor so they gave me to my aunt. I lived with my aunt since I was 5 and came to America with her family in 1985. Now I'd like to petition for them to come here but not sure if that's possible. Please help.

Are you sure you were not legally adopted? The only way your aunt could have petitioned for you is if she showed proof that you were her child (either biological or adopted). She would not have been able to petition you based on an aunt-nephew relationship.

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

Even if you were considered legally adopted by your aunt, is she now a USC? Is your mother or father her sibling?

Even if you were considered legally adopted by your aunt, is she now a USC? Is your mother or father her sibling?

I asked my aunt and she told me that i was legally adopted. My parents did sign the adoption paper and I did some research over the last few days and it looks like that adopted kids cannot petition for their natural parents. My aunt is my dad's stepsister (to answer your question).
