K3 to CR1?

Timeline

At the time I sent in my I130, I thought I wanted to go the K3 route. But, after more reading and research, I think I want to just go with the CR1.

My question is this...

When I prepared my I130 package, I indicated on the Cover Letter that I was petitioning for a K3 visa. Will they now hold on to the I130 and wait for my I129? Or, will it automatically get processed as a CR1 if I don't send in the I129?

It's hard to know for sure at this point. I'd lean towards simply doing nothing and letting the I-130 process. Notifying them by phone might work but it might also confuse the issue.

Pushbrk is right, and confusing USCIS is the last thing you want.

It seems that when the I-130 gets approved first they now don't take any further on the I-129F, though it is safer at this point to let them decide and cancel the K-3 application themselves.

I did the same thing and Im wondering now what next step I should take. I also stated in the cover letter that i was filing it with the intention of applying for a K-3 visa. I have the I-129 almost ready to send out and now im wondering what i should do. let me know what you find out if anything.

Since I never sent in the I129, I'm technically not on the K3 track. It's just that I mentioned on the Cover Letter in the Subject Heading...

Since I never sent in the I129, I'm technically not on the K3 track. It's just that I mentioned on the Cover Letter in the Subject Heading...

SUB: I130 Application packet for Spouse - K3 Visa

They'll probably just ignore the subject line on your cover letter. They can't possibly put you on the K3 track if you dont file I129F.
