I WAS JUST WONDERING IF ANYONE KNOWS HOW LONG AFTER WE MARRY.. DO WE HAVE TO FILE AOS .. I KNOW WE HAD 90 DAYS TO MARRY AND WE HAVE DONE THAT BUT DO WE HAVE TO FILE THE AOS IN THAT SAME 90 DAYS OR BEFORE VISA EXPIRES :help::help::help:

From My own experience, I think you would focus on getting his Work permit , so he would be able to keep his job and stays calm and positive.after three months from his arrival to the USA, the stamp on his passport for will expried and they usually dont extand it, you can fill in his papers when you get your money and all your papers ready..... The work permit is very important and he can obtains it from 2 months to 3 months,if he applys for it as soon as he gets here.DONT LET HIM TAKE RISK AND GO TO WORK WITHOUT IT OR HE WILL GET HIMSELF AND YOU IN BIG TROUBLE WITH IMMIGRATION AUTHORITIES IN YOUR AREA.GOOD LUCK.

It all depends on how important is it for him to Drive, Work and Travel (outside of USA) - most people file for AOS as soon as they can - some have waited for a year or more. Good Luck

Unfortunately, as a K-1 you need to file the AOS in order to get a useable work permit. If you file right after he gets here - before marriage, before filing AOS, the work permit would be based on the K-1 status and only valid for the length of the I-94 - 90 days. It takes approximately 90 days to process a work permit- so it is probably expired by the time it arrives -plus you wasted all that money. Also, the K-1 work status authorized by a stamp in his passport when he arrives (not every POE gives it) cannot be extended - it expires when the I-94 does as well.

There is no regulation that says you have to apply for AOS within a certain time period, but for your own best interests it is best to apply for it as soon as you can, ideally (but not necessarily) within the 90 day period stated on the I-94. Be sure to apply for the EAD and AP as well as they are most likely to be processed faster than the AOS and are included in the cost.

What you should do shortly after he arrives - in about 2 weeks, no later - is apply for his SSN. It will make a lot of things much easier further down the road.

Just out of curiousity can you post a link to a thread where this has happened? As far as I was aware it is advisable to file for AOS within the I-94 validity period (after marriage within the 90 days) but other posters seem to state that the USCIS allows some leeway with submitting the AOS documentation (provided of course that the marriage took place within the 90 day timeframe)
