???? about part of EAD I-765

Timeline

I am filling out the EAD for my new wife and have a question about part 16 of the form I-765. I lloked on the example forms portion of this website and it has c 9 in that part of the form. My question is: My wife came over on a K-1 visa is that what we should put in that part of the form? I read the corresponding CFR and even though I work for the gov't reading those things makes my head hurt and just gets me more pissed at law makers, but thats another story. I am guessing that c 9 is the correct thing to put in that part of the form but I just wanted to be sure.

Our Timeline:

Dec 1 05 - Met in London

Guy was on vacation Val was living there.

Mar 06 - Guy went back to London

Mar 06 - Val came to stay with me in Greece where I was living.

May 06 - Val went back to London

July 06 - Val came back to Greece and stayed until Oct 06

Oct 06 - Val went back to Brazil

May 07 - Val tried for tourist visa to U.S. DENIED!!!

May 07 - We decided to get married. Hired Lawyer

July 20 07 - Lawyer sent I-129F to VSC

Aug 9 07 - First of probably a few trips to Brazil for Guy

Aug 14 07 - NOA 1 Date

Aug 23 07 - We get officially engaged!!!!!

Sep 03 07 - Guy went back to USA

Dec 03 07 - NOA 2 Issued

Jan 22 08 - Embassy Interview

Jan 29 08 - Arrived POE Atlanta

Feb 09 08 - Wedding Day in New Orleans

That is what I used and she got her EAD in about six weeks or so.

C 9 Based on the "Pending I-485" that you will be filing the I-485 with.

Filing the I-765 BEFORE the I-485 using code A 6 will result in a temp EAD card that expires the same date as the I-94 card. Also filing before filing I-485 requires a $340 fee. A 6 EAD takes around 90 days to get, so for K-1 holders this is a useless EAD card.

How about for K-3 VISA HOLDERS, what (code) goes in that section when filing out the I-765 along with I-485??

Make sure you do this right because we didn't and I was worried we'd be denied (others have been). Luckily for us, I found the mistake before USCIS could deny, but we had to make 2 infopass appointments to correct the problem.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

Make sure you do this right because we didn't and I was worried we'd be denied (others have been). Luckily for us, I found the mistake before USCIS could deny, but we had to make 2 infopass appointments to correct the problem.

C9 (code), are you sure it's the same for K-3 visa holders than for K-1? I just want to make sure.

B. K-3 Non immigrant Spouse of U.S. Citizen or K-4 Dependent--(a)(9). File your EAD application along with evidence of your admission such as copies of your Form I-94, passport, and K visa.

If you are a K1 or K3 visa holder who is filling for AOS and EAD the the code is c9.......

Adjustment Applicant--©(9). File your EAD application with a copy of the receipt notice or other evidence that your Form I-485, Application for Permanent Residence or Adjust Status, is pending.You may file Form I-765 together with your Form I-485.

NO!!!!! if you are sending the I-765 along with the I-485 then it is code c9.......

it is only if you are applying for I-765 on its own as a K3 visa holder that you use a9......
