Travelling before Green Card runs out.

Hi all,

Cris and I will be travelling to Spain this March and returning to US before her card expires in April. We'll be filing this weekend the I-751 but were concerned if we don't recieve a NOA before we leave. We've had this trip booked for months, even have the baby's passport but I've read conflicting reports on whether to travel or not and whether I would need to make a INFOPASS appt and attempt to secure an AP. Any of the process experts here have an answer?

You do not need AP.... You simply carry the NOA1 with you as an indication you have filed for the next level of benefit... There maybe something that can be done at infopass but it is not AP

I am not following you here, you say that you will leave and return to the USA BEFORE her card expires. So what is the problem?

Thanks for your responses but fwaguy, what if I don't have the NOA before we leave on the 3/12/08? YuDan, I've been told that once you file, even though your card hasn't expired it could be an issue, especially if you don't have your NOA in hand before you leave

I will Jasman but I've been told that once you file and you're in the computer, if you are traveling out of the country and don't have your NOA in hand that it can cause problems upon return...even if her green card doesn't expire until after we get back....just trying to separate the fact from the fiction...you know how rumors start, but I've got nightmares of returning to US with our baby and Cristina having an issue at the airport.

I flew to Scotland 2 weeks before my card expired and returned the day before it expired... I did not take the NOA1 extension letter with me as my greencard was still valid... I had no issues... the CBP officer just asked how long I had been gone for and asked if I knew my Greencard was about to expire, I told him I had applied for ROC and I did have an extension letter in case I needed to travel again after the Card expired... he said it was good to see someone who was doing everything at the right time... He said Welcome Home and handed me my Passport and my Greencard and I left...

You will be fine as long as you are returning before the expiry date....
