2nd Fiancee Visa Petitioner.. is that gonna be a problem

I filed for a fiancee visa in 2001 and everything got approved. We got married and got divorced in 2005 due to irreconcilable difference. I met another girl when I visited my country last month and fell in love (again). I'm planning to petition her using Fiancee Visa and i'm wondering what are my chances of getting approved if it's my second time. Should i just go ahead and go back and marry her and petition her using I-130. Has anyone here been in the same position as me?

I'm sure others have been in this position before, as the I 129 asks if you have filed a petition for another alien fiance/e before.

No one can tell you what your chances of approval are. You'll just have to roll the dice and go with it, whether you marry her now or not.

The chances of getting approved depend on all of the circumstances of the case, the fact that it's a 2nd time not necessarily being one of them.

This is my second petiton, yet it is for the same person, I cancelled the first one due to the fact we were not quite ready. Our first one was in 2002, I spoke with an attorney and he said that as long as no laws were broken there is nothing wrong with petitioning twice. So, I don't think there would be a problem for you. As to it being approved and how long it would take, no one can answer that question. I think mine is taking a little longer than others, I don't know if it is due to the fact it is the second petition or not, or if it is just because CSC is slow, who knows....I did email them and they told me it was just regular processing issues and security checks, so as for now I am not having any major problems with mine.

Hope everything goes smoothly... if you're able to answer the questions fully and honestly at the interview, and explain the circumstances, it shouldn't be a problem

I don't really know the answer but I would think it wouldn't be a problem. When people are honest it goes a long way.
